Hello to all,

As I see that many of you had problems with the deposits you gave to Herrada-San Jose, I must say that my lawyer in Spain won my case regarding the guarantees. As most of you, we didn't have any individual guarantees to our name, they were just general guarantees.

I know that every client has the same right as me so I asumme that you can recover this back too.
We won against the banks Banco Pastor, BBVA and SGR and they already paid our guarantees back.

Did your case go to court i,e hearing and did the banks appeal the judges decision (assuming this was the process) ?

My case went to hearing and the banks appealed the decision but I already have the money as my lawyer enforced the decision provisionally, so they paid and now we are waiting for the Appeal Court.

How long is the meeting scheduled to last as I may attend ?

 I dont know how long the court case will take but I suggest you allocate a few hours. I am flying from Belfast and doing an ovenhight in Alicante.

Dear All,

It is true that there is a way to recover the funds paid to the developer when the construction was not finished and the developer did not issue a bank guarantee. 

We have claimed against the banks mainly in the north of Spain and all the cases were won. In some ocassion, the bank negotiated before the claim is submit ted because it has been already obtained a judgment where it was stated the bank had to return the funds.

I do not know where you live because we have already meetings with people who are in the same situation, money paid and the property were not finished. We explain all the points. I am also in the process of contacting the creditors of the developer as in some cases there were issued bank guarantees with an expired date which is not valid under law.
