Regarding the snagging list-
With trust worthy building firms in Spain who communicate with clients and who are not rude like Raquel it is normal to do the snagging list after completion BUT unfortunately we did not buy from a firm like that so I have NO intention of completing until the snagging list has been completed by myself and a independent company which I have asked to help me do it.
Raquel has refused this but then that is no surprise as most of the time she doesn’t even answer my calls, so why should she do anything that helps a client that has given her shed loads of cash
I would be interested to know how other owners feel about the snag list and if any other owners are refusing to sign until the snag list has been completed or if they are happy to sign and snag later?

Message To Grego and anyone else who's completing their purchases soon?
PLEASE Don't be bullied into completing your purchases by Grupo or their not so elequent mouthpiece Raquel before the snagging of your apartment has been completed to your FULL satisfaction! She really is NOT a very nice person who lies openly without any thought for the investors at MHV. Remember this is the company who "forgot" to supply more than half of the buyers with a Bank Guarantee that is a legal requirement in Spain!! They also omitted to tell us about changes to plans, or contractors (the first one went bust!) or the fact that they are more than a year late due to their own incompetance! This is not forgetting that some of the build quality is some of the worst I've ever seen, even by spanish standards some of the work practices have been attrocious!! (I probably have over 1000 photos that show many instances of very poor workmanship thats now been covered over by plaster and render)
This is your last opportunity to take control of something has Grupo will be long gone after youve signed over the balance of your purchase monies? They are the company who broke the terms of their own contract. We of course being the people we are paid over our deposits ON TIME within the terms of their own contract!!
I was on site just 2 days ago and there are still contractors on site finishing off work!

I Was advised by my lawyer that you can't use the snagging as an excuse for not completing. Normally you complete and then do the snagging. They have an obligation to address the snagging within 2 weeks. From a recent visit to the appartment I couldn't find any major defect at first glance unless there is a significant leak or other structural problem that I am not aware of.. I am appointing somebody to do the snagging after the completion as the developers refused point blank allowing anybody but myself in the appartment before completion.

l am out there visiting the apartment on the 9th April. l have advised the lawyers that l have no intention of signing untill all snagging is completed to my total satisfaction. Because any bargaining power will be long gone otherwise.. l am intending to visit the lawyers whilst out there.
What can they do? will the developers take us to court !!. l am not saying that l will not complete in fact the opposite but only subject to my condition of the snagging being completed.

I don’t know if you have the same lawyer as me but mine is Lex Marbella, which I’m guessing most owners used as Viva recommended them.
I see it this way - 40 people have read this thread and the idea occurs to me that if most are with Lex and we all say the same thing to Lex that we want snagging completed before contract exchange we and Lex would have a much loader voice.
Dear Raquel and Grupo, think of this from your clients and owners view – you say you will complete all snagging 2 weeks from signing, well we have waited 18 months longer than we should have for you to give us our apartments so why cant you give us 2 weeks? We will complete but don’t expect trust when you have done nothing to earn it but in fact done the opposite

Lex Marbella represented owners of 25 apartments . At least 10 of the units are involved with a court case(mostly with different lawyers) so will NOT be completing in the near future! I would expect at least another 12 are involved in litigation through the courts. I don't beleive that you will need to form a group just tell them that you won't complete until everythings done to your satisfaction. It took me months to build my action group and you don't have much time to organise everyone? Yes, get Lex to do something but they have performed poorly to date and appeared very weak in their negotiations with Grupo last year!
Just what will Grupo do if you put your foot down and not complete yet. They would need to begin an action against you for breach of contract. Is that realistic when they have to complete comparatively little work in return for a full price sale completion?

I am new to the property market in Spain and this was my first venture. Like the rest of you I have been very unhappy with the whole project. Raquel offered to pay for my wife and I to visit the project last summer but every time I call her to book a visit, I am told she is not available. I try her mobile and I get on reply. I would be very interested in your view of the condition of the properties when you visit on 9 April. My lawyers (Lex) are trying to get me to book a completion date.
I would also be interested in details of any local professional builders I could use to create the snag list.

I was also offered a visit to fly out to Spain by grupo and just like you I made lots of calls to the rude Raquel and every time I was told she was not in the office and although I asked her to call me back she never did. She also would not return my emails. I had to get Lex to email grupo and guess what she called me the very day he emailed her saying total rubbish like I have been trying to get hold of you!!!!
No surprise when we went to look at the apartment she was no where to be seen and sent a replacement to meet me. I was also told there would be a car at the airport … guess what …. yes you guessed right there was no car and we had to hire one. Words cannot explain how incompetent I think she is and if I can find a way of complaining to her superiors I will

l am flying out tomorrow and will be doing the snagging list with someone from Grupo on Monday 9th April. l have informed my solicitors that l will not be completing until all snagging is completed to my satisfaction.
l will let you know how l get on after Monday. l will also be able to let you know what the development is looking like.

Hi Everyone
Not surprising you have been met with this sort of incompetence. Grupo wanted everyone to go over to Spain last year in order to look at the site and discuss things with them. This was after months of their non replies to letters, phone calls and emails. Most of us chose not to do it because it was just Grupo's ploy to act like concerned developers. Don't forget we never heard a word from Raquel or Grupo until we started complaining and posting the last lot of photos on the forum. Then she came out of the woodwork saying not to believe the person that placed the photos on the site because they were not a true reflection of the current state of progess. When in actually fact that person (and he is our friend ) painted a very good picture of the state and quality of the development. He also gave a true reflection of the building as a whole and not just photos of the angles where purchasers could see the development in a better light. This incompentence and rudeness is what Raquel and Grupo have been like all along. I along with others do not trust her and of course do not trust Grupo.
