Got our final hearing later this month but have been informed that we MUST attend the court in case we need to answer questions. If we're not available to be questioned then it automatically goes against us. Has everyone else had to attend their final hearing too? Wasn't aware this would be part of the process and to be honest don't think it's necessary. Can our costs be added to any others recovered (should we win)? Also wasn't aware that it will take up to 20 days for the judge to decide the outcome. Would have thought that given all the other case outcomes it would be fairly easy to come to a decision then and there. I'd even be prepared to bring a bit suitcase to take my money home in :-)

Had our final court hearing yesterday which was an interesting experience. The bank spent most of their time trying to pass the buck and their lawyers gave us quite a grilling too. Very glad that part is now over. Our solicitor advised that it would be about 2 months, possibly a bit long, before the judge made a decision.
It was our first time back to the area in 7 years and it certainly made us remember why we'd fallen for it in the first place :-(

Hi,
Which development/bank are you claiming against and who is your solicitor ?
I hope overall you feel the hearing went well for you even though the waiting game continues ? Our hearing was in Feb and still no sentence or even when we can expect the sentence. I know this is a process but you are right the banks blame each other whilst the waiting and stress impacts on our daily lives.
I hope you get the outcome you deserve i.e return of funds.

We're claiming against BBVA using Costaluz.
Our solicitor said the hearing went well so I guess we hold onto that! One of the funniest questions from the other side was 'why have you taken so long to bring a case against us?' Seriously??? Do they not know how long their own system takes? Thankfully managed to remain straight faced in front of the judge!
Guess we just carry on as normal and forget about it for now.....

Thanks for the prompt reply.
Our case is against BBVA as well (our money went into their special account). HDT, Santa Ana.
I never realised it could take so long for the judge to make the sentence unless this is a recent development but yes, try and forget about it as it is out of our hands...

Hi , just to let you know our court case was in Murcia and it took the judge over 18months to make a decision, thankfully in our favour. Waiting now to see if an appeal is challenged .This ordeal started back in 2007,will be glad to see the end off it. Great work by the Costaluz team.

Hi Ah, can't believe it could take that long!!!! How on earth can it possibly take that long, it's just so unfair. Three months for us so far and that seems a life time

Hi, we were in court middle of Nov 13, we were grilled by the banks lawyers, They also asked us why it had taken so long to sue them, and why we voted against the 65% offered by HdT! We eventually won the case, it took 5 months because the person who deals with the sentencing was off sick. We are now counting down the 20 days the bank have to appeal the judges decision. We hopefully should have our cash back by the beginning of the summer. Keeping everything crossed. Wishing everyone in the same boat a positive result,
Cheers Joanniemac

We have our date for final hearing in June. We will be attending, as advised. We were told it would be 20 days after the court date that we would get a decision, but that does'nt seem to be the case from reading other threads. We will have to wait and see what the outcome will be, keeping everything crossed for ouselves and everyone of you going through this stressful time.

Hi , We stayed at the Tryp gran sol in Alicante. Its one of the tallest buildings in Alicante, easy to spot from a distance. Wasn't too expensive, basic, clean rooms, good selection at breakfast. There is a taxi rank just outside cost us 4 or 5 euros to get to court. We took the bus from the airport and got off at the marina & walked back to the hotel, took about 2 minutes. Hope this helps & good luck on the 19th. Cheers Joanniemac
