PURCHASE PROPERTY THROUGH AMBASUN

Hello All

We have been following the news about this failed Spanish property venture for sometime now. We purchased our property for this developement through Ambasun and have cancelled our contracts with Herrada del Tollo through our solicitors Irwin Mitchell.

Is there anyone out there in a similiar position as us who are just waiting for the staged payments which should be paid back to us in stages as ordered by the court. Or has anyone who bought their property through Ambasun managed to get their money back through other legal action.

We paid our money into a Spanish Bank called Bancaja, I do not know if anyone has managed to get their money back from this bank.

It would be nice to hear from anyone in the same position as us as we feel as if nothing is happening , we do not hear from our solicitors as they have done what was required of them by cancelling our contracts and as creditors we were advised by them to wait the outcome.

We are in a similar position to you, in so far as we are hoping to get some of our money back via the staged payments.  We have actually bought another property on the edge of Jumilla, where I am sitting while typing this. If I look through the balcony doors I can see the Sierra de Santa Ana, which is what I had hoped to do if our house had been available at the promised date!

So far as I am aware, the courts in Murcia still haven't given a decision about the development, although it is past the deadline for receiving representations from all parties.  SARC are hoping that the decision will be reached by the end of this month! I will ask Tony to provide an official update when that happens.  IF the courts tell Herrada del Tollo that they can go ahead, apparently they are confident that they will get the necessary finance, now that the development has been scaled down.  If the answer is no, then John and I will have to decide whether to take legal action to get our money back, though I for one don't have vast funds in my bank account!

Please feel free to ask me any more questions and I will do my best to answer them.

Also, if anyone is planning to visit the area, do drop me a line. There will be lots of activities here in Jumilla over the next few months, so it is definitely worth a visit!

We bought through Ambasun asked for and given a bank guarantee it was faxed to me so I never got the original
it is nothing to do with bancaja now T/A Bankia you would have just paid your deposit into that bank as it was the one used by Ambasun

To cut a long story short we did get our money back 3 yrs ago after a long battle

I would keep on at your solicitors you need to keep the pressure on and tell them exactly what you want them to do the same as with any legal they work on your instruction not thier own initiative so get back on to them and ring them every week it will work in the end cos they will be left in no doubt as to what you expect of them

We also bought through Ambasun and paid them direct. We pestered them for a bank gaurantee and they told us they were issued by HT, so we pestered them for ages, even going to their spanking new office in Orihuela and obviously told lie after lie that it was coming in the next couple of weeks. What bothered me at the time was the guy in Orihuela, I think he was called Toby would not look me in the eye as he told these lies.

So when should we expect the stage payment to commence, we also cancelled our contract and changed lawyers to DWF in Manchester as they have a Spanish lawyer working for them, it all seemed positive as a number of other people joined them also, however information has now dried up and we get maybe one email a year from them. We had to pay an extra 50 euros for their barrister to appeal the courts about us just being ordinary creditors and guess whats been done, nothing as far as I know.

"Yes", we too used Ambasun International, and "Yes" we too did not have a bank guarantee !

I suggest you go down the same route as us, if you're able to afford it that is ?

Our original Spanish lawyer cancelled our contract, charged us a small fortune, and did little else !!

We are now with Costaluz Lawyers ( Maria Luisa De Castro ), who is commencing legal action against the banks, for many clients that are in the same position.

She has already won a number of cases using this method, and got the full deposits back, along with costs and interest.

Yes, we had to pay a large amount of money up front ( we obtained a bank loan ), but, we feel this is our last and only shot at getting our money back, and are confident that Maria and her team will be successful, as she has been with the others !!

                            We didnt attempt to buy with ambasun but we are in the same boat as you. We are not waiting for the stage payments as I very much doubt they will ever happen, I dont think the company will complete Santa ana and will not be in a psotion to pay out.

We are also with DWF and have instructed them (as a number of others have ) to proceed against the bank.
