in june 2002 we put our deposit down on a two bed-two bath apartment at Angel de Miraflores. It was a huge mistake as it's turned out for us. We have been let down by Aifos, Oceanview and GVA from the word go.  I realise not everyone is in our situation, so to those who are happy, and got what was written in their contract, (apart from the hideous build time!) good luck and all the best.  As for us, we are going to court to get our deposit back on the advice of lawyers who post on here and on the other main site, that feel we have a very strong case. I thought the post explaining the details that i put on another site might be of interest to some.

my development was to be Angel de Miraflores in Mijas. For those not familiar with it, nice location, poor build quality, over 4 year build time instead of promised 18 months! reported local stream problem, sewage problem, drainage problem, so still no LFO. Never had a BG from developer. More appartments crammed in to same area, so looks nothing like our original plans etc etc.

I think some problems above are, or have been sorted, but just to cap it all, our appartment size in our contract was 100m2. After nearly 4 years the developer said they had made a mistake and sold our appartment, but we could have a replacement one in another block, not much more than half the size, with no discount!!!!!!

Many have completed on this site, and some i understand are happy, and i assume got the specification in their contract? Others were ''advised'' to complete on the threat, that if they don't they may lose their deposit and apartment, as the developer may go bust while trying to sort it out. Others, due to the almost unbelievable build time, stress, strain, sleepless nights, worry, have completed out of desperation, and are 'making the best of it'

From our point it's just a bloody big con, from the start, by a bunch of sharks, and judging by the PM's i've had, it's a similar story in many areas of the CDS.

Anyone wanting a balanced opinion, needs to include the above, we are not alone!!!

WOW!!!!!!!, you are right!, similar stories at these three developments, how many more i wonder.  It makes my blood boil. At some stage, we have all had to trust these err........people?, and it's now very clear how much that trust has been betrayed. How many of us have been conned or misled, i shudder to think? Made a few people very rich i  think, and they dont give a toss about about how many peoples lives are being ruined due to their lies and greed. Just very wrong!!

Hello Claire,

I would like information of your proceedings I have suffered the same as you and am currently having legal proceedings made against me my from the bank to repossess my ground floor apartment in Block 6. I have been informed if I can't deposit 2100Euros they will proceed.

I was able to fund my mortgage for quite a while even though the build was not complete but I still have not been able to rent it out due to problems with the agent I used ** EDITED - Names ** who basically conned me.

I would like to sue aifos for money lost, stress etc it is hard for me as I am currently living in Asia and have business committments.

I would very much appreciate any details you could give me to help me also proceed to take legal action against Aifos. Who are your Lawyers? Is there a group of us who are claiming together or is everyone claiming seperate?

I am sorry if I am duplicating questions posted before but I have only just discovered this forum.

I am standing to lose all of my deposit because of them.

Hi all

just like to remind everyone about the superb petition that Suzanne has set up on SPI. I'ts really gathering steam now, and many people are giving up their own time free of charge to promote it and help all of us. Please check it out and add your signatures and let Suzanne hear your story. Once as many have signed as possible, i'ts going to  No10 downing St. and others in the EU who can help change the dreadful justice system and expose the many sharks in the form of developers lawyers and agents, in Spain and the UK  mainly,  who have made a fortune out of misleading us all,  with regards to build times, development plans, breaches of contracts, licenses, services and also other problems that you who have completed have found. We really need everyone to stick together on this. I believe from a sales or rental point of view, it will help everyone in the long run who has been badly treated.

Goodstich - You have been reminding people of your issues with regard to OV and Aifos at Angel de Miraflores for the past 4 years please give it a rest as some of us are totally pissed off with attitude. I am begining to wonder if you are professional moner and that all you have time to do is mone about your problems at Angel. Perhaps if you used a decent estate agent and lawyer you might not be constantly complaining.

Please now give it a rest and some of us who bought at Angel enjoy what we paid for without the constant reminding of your personal problems.

Hi Russell

We Agree we all have had our problems with Angel but have just got on with it and now we have the H/L its great news and we are doing really well out of our rentals.

Although we do feel sorry for goodstich44  and others like him, but some of us have had to get on with it and make the best of a bad job  which we are now doing.

We wish you and every one else on Angel the best  for your future and hope everything goes as well as it is for us at the moment.

P.S we used the same agent and lawyers as goodstich44.

as i have said before, i wish all the best to those who got what was in their contract, and are happy with their situation. We and many others didn't, and so have taken action to back what is rightfully ours. What do you think we should have done? ploughed a load more money in to an appartment not much more than half contract size, after waing nearly 5 years? Do you think that's fair?  Do you at least have the balls to sign Suzanne's petition and actually help all those who have been wronged?   Why are you calling  it  my  'personal problem'? Do you not think the problem is with the developer/agent/lawyer? for trying very hard to swindle us?, or are on on the side of these sharks?

Your attitude of  'i'm alright jack', does nothing to help change the situation that has robbed many people of large sums of money, through no fault of their own. If you are happy with that, well that's your decision, but don't expect me to be.

Your attitude is disgraceful and inhuman. If you had one grain of empathy for others then people may warm to your situation. Have you ever heard "what goes around, comes around" or "you reap what you sow"?? Attacking those who are standing up for what they believe is right ,is admirable and deserving of support. Goodstitch, as you know from the past, you have our full support and best wishes and there are many others on this forum who have agreed with you and supported you over the years.

THE BEST OF LUCK FOR A POSITIVE AND JUST OUTCOME.

Have I missed out on how to sign the petition?

thank you so much for your support. I do feel a bit like a one man crusade these days with regards to' Angel'.

I do sympathise with all those who are happy, and also those trying to make the best of a bad job. We all did what we thought was best at the time. What i can't symathise with, is those who are criticising me for just trying to get a fair and just result, and just as bad, criticising those of us trying to change the justice laws in Spain for the good of those following us. Why would any good people be against that? I understand that some are sick of bad publicity for the CDS, and of course i would love to see an end to this, but not before Spain is forced/persuaded to give justice to those who deserve it and deal with the sharks in the way they deserve it!

Suzannes petition can be added to, by contacting Justin, who runs this site, and has kindly helped to join in the fight for justice for many people who have been ripped-off, or who like us, would have been if we hadn't been prepared to go through a long and expensive battle to get back what is rightfully ours. Ours is an ongoing situation that we are confident we will win, thanks to a good lawyer and support from the good people on this and the other main site, and of course dear family and friends.

thanks again for your positive words, it's been a tough time for us, and support from good people who understand our situation is very welcome.

Hi Goodstitch,

We would also like to offer our support. We are really happy with our purchase ( although 20 square meters smaller than expected, and we're apparently are the lucky ones!) I think most of us would agree that the fact that things have worked out pretty much ok, was luck rather than judgment, and anyone of us could have ended up in the same position of many who have lost their money. Keep up your fight!

thanks for your support, so pleased things have turned out OK for you, and i think your right, i think most people were short on appartment size, to varying degrees. What with that and all the other issues, the developers/agents really did get away with daylight robbery, but i think that's common knowledge, so i'll shut up about that!

We will keep up the fight, ours is such a clear case of massive breach of contract, it's hard to believe the developers would expect us to swallow it..........but then again, knowing who we are dealing with?
