I know that most of us think there will be 5 pools in DV so when in the developer's office today I asked Antonio Munoz where is the 5th located. Ho showed me a recent arial photo and obviously the 4 we know off could be seen. As for the 5th he pointed in the general area of blocks 18 20 21 and said in this area WHEN IT IS DECIDED TO HAVE ONE. To conclude the 5th pool is not certain.

That would be a little sad if they don't build a pool there!  It would mean that all the blocks from 18 upwards would not have their own pool there!  I know that basically, the developers could put a rabbit hutch there and we couldn't say alot (the same as they have repositioned the second smaller pool on phase 1, according to the plans we have!!), but it doesn't actuallly make for better relations between investors and developers, does it!! 

I do hope those investors in Phase 3 will question the position!!

I wonder if this means that they could build a pool at a later date after completion which would be most disruptive to say the least! And what happens to that land in the interim?

What about those who purchased with the specific knowledge that a pool was to be built between blocks 18 & 20 (i.e. according to the marketing/plans). I wonder how purchasers stand legally with regard to any potential change of this nature?

Why the shift in provision?...... is it due to lack of space, financial cutbacks, maintenance considerations, etc. Does this mean that all those in the later blocks will be using the pool between blocks 15/16/17? Has this pool been resized to accommodate the extra blocks?

We need clarification on this situation as soon as possible.

Anne, jan With nearly 700 units when complete I don't think they can afford not to put a pool. I have seen them building the pool at block 16 and it is anout size of block 10 pool. But there doesn't look like much space around it. I will photograph later and post. I think we should all protest to RYF personally and collectively. Also there must be quidelines on provision of pools. Number of people per pool. At this rate next summer there could be about 2500 people sharing 4 pools!!! You would need to be german to get your towels out early for the best spots!!!

Update- just posted 3 pictures of pool at block 16 and one looking towards blocks 21 etc

Just heard back from our agents who advised as follows: (seems like a forgone conclusion)

" I have had confirmation from the developers at Duquesa Village that there will be 4 swimming pools throughout the development. They will positioned in front of blocks 3,4,10 and 17. I have been advised that there is not enough space between blocks 18 & 20 for a swimming pool.

 
I have also been informed that the pools for block 4, 3 and 10 are now finished , but the remaining pool by block 17 will be completed in approximately 8 months.
 
The land between blocks 18 & 20 will be a green area. "

I have just emailed the developer and my solicitor to see what is happening.  I bought in block 19 Phase 3 under the agreement that a pool was to be behind our block or just to the side.  If there are other people in these blocks then let me know if you have heard anything, and I think as posted here, we need to keep in touch with each other to see how we stand.  Why would be buy without a 5th pool here?  I am most disappointed as I know others will be.  Ros Y Falcon are not the deveoplers I thought they were to be, but I do not suppose I could have expected any more from them than this :(

We are in Block 10, and when we picked our apartment it was specifically because of the location - near the pool, away from the road, etc.  I'm sure there are many people who have bought in Phase 3 who have bought for the same reason and cannot understand why, after receiving planning permission, obviously having expert architects, planners, etc., (sorry, don't know all the people involved!!) they have suddenly realised there isn't enough room for a pool between these blocks.  SO MAKE IT A SMALLER POOL!!  And why was there room for a pool when they were marketing the apartments????

Personally, if I had bought in Phase 3 I would be particularly peeved at this moment!  Last year, we stayed in Marina de la Duquesa, which also has four pools, but (and I'm not sure) I don't think they have as many units as Duquesa Village.  But I can say that the pool areas got quite busy during August, when we were there!!

Nothing really helpful here, sorry, but just wanted to voice off!!

Our apartment is ( will be ) in Block 18. We were told when purchasing that there would be a pool at the back of our apartment, that we would literally be able to come down the stairs and be at the pool. We were assured that everything is worked out very scientifically by architects, planners etc. in relation to space. There is absolutely no way that RyF did not know there was not enough  room for a pool. It seems like very sharp practice to me. The apartments in Phase 3 are probably less attractive in terms of seaviews, view of golfcourse etc., and were made more attractive by the inclusion of a pool. So, I feel that we were duped into buying, and must have some rights of redress.

I am absolutely furious at this news, and wonder what our legal rights are in this situation. Four pools between 700 apartments is simply not enough, particularly in high season. Is there any way RyF can be forced to provide another pool by building fewer apartments, if necessary. At this stage I think that I would prefer to have my money back, instead of completing on an apartment that was missold.

Sorry about the rambling nature of this post, but I really am wondering what my rights are at this stage. I suspect that I don't have any rights. Has anybody  got a site plan of the entire development showing the position of the pools that were proposed? If so, would you be willing to e.m. it to me?

Maybe, once you have individually contacted RyF, you all may consider the response received from them and then contact Maria de Castro, lawyer regularly seen on this forum (who has, I believe, obtained deposits back for investors from RyF - or at least one that I'm aware of).  Personally, I agree with MCK, that I cannot understand how the build does not now include the pool, due to space available.  Or is it due to budget??  Although, saying that, it really isn't a big expense (on the scale of things) to put a pool there, so did they make a massive boob when planning?  I do know from the site plan we have (that, in fact, is very vague and only shows the pools in Phases 1 and 2), the second, smaller, pool at the bottom of Phase 1 was initially across the road from where it is now.

I would be livid if I was a purchaser in Phase 3 and, in fact, it obviously affects us in the other blocks!!

MCK, the plans I have don't show pools anywhere in Phase 3, otherwise I'd email them to you.

This is the 2nd planning issue I'm aware of. The 1st was a shortage of space for 2 cars in Block 15's car park.  ( I was told that these 2 units have not been sold.) Obviously this pool issue is much worse. Hope it can be resolved as it affects all of us!

I will try and take some photos of the area in question today and post. I agree with the fact that people have bEen misled when purchasing and consequently there is cause for a claim. This effects us all. At the pool below me in block 4 it says 53 people permitted to you use it ie its capacity. Block 3 its I think 125 people. 178 people for these 2 pools. So double that for remainig 2 pools. 356!!! Not a lot for a site with almost 700 units.

It's not just the pools, what about the number of tennis courts. Is there going to be more than just the one court ? Not many for 700 units.

I have just posted 4 pictures of the area where i think the pool should be between 18 and 20.  Looks as though one could be built there but it would be tight.

JohnH...when did you take up tennis?  - got you a great aerial photo of the site by the way.

I understand the disappointment when you expect a pool near to where you have purchased.

Check all the paperwork you have because I think I have seen a note in one of the brochures to say that the developers reserve the right to make changes.

Its always best to go to RyF office to complain because if they have prospective buyers there and you are complaining out aloud they are more receptive than an email or via your lawyer.

This the same post as uploaded photo's.  Just want to be sure all who need this are aware:

I have had notification from our Agent that there will be no pool behind these blocks and we have to contact our solicitor.  Antonio from RYF has emailed to say any communication re cancellation has to be to the adminstration department through our solicitor.  It is a bank holiday in Spain today so am waiting to hear from them. 

If this is an issue for you too I suggest you start with your solicitor.  When I hear back I will post replies on this.  Looks like the decision is final and it will not only be a green area but possibly a child's play area.  I am over in Spain w/c 19/05 so will definately be expressing my disappointment in the office for all to hear!

I have just been informed from MRI, the agent we have bought off, that RYF are definately building a pool in this area.  There was a  technical fault (apparently, who knows) and they have now decided to go ahead.  I have asked for confirmation from MRI as Antonio confirmed this.  I would hate to think that a few months down the line it was not built.  So all this fuss over nothing I hope!  If anybody hears anything contrary to this please let me know.
