Community of Owners Query

The community I live in has no Community Statutes or written Community Rules..We have a President & we have occassional meetings but it remains very informal.I feel I have little protection against actions taken which may put me at a disadvantage.Is the community still a legal entity? What can I do about changing this?

Which community do you live in? Do you live in an apartment or other property with communal facilities? If so, you will be covered by the Horizontal Property Act. This sets out the minimum responsibilities of owners on a community with shared facilities.

Anything over and above the minimum responsibilities needs to be agreed by the community as a whole and written into the articles of association of the community, including how the community is managed.

In order to change it, why not get the support of other owners in the community to create and agree the relevant articles of association.
