I have been trying to find out the situation about the licence they mention
you should need to rent out the property to tourists. Nobody seems to know
anything. I approached our tax adviser and he will enquire with the Junta de
Andalucía (the government of the community of Andalusia). He reckons that
the situation might be different from area to area, since these matters are
regulated by the "Comunidad" (= Andalusia, Catalonia, Bask Country,
Baleares, etc.), not by the Spanish State.
As a non resident owning a property in Spain you have to fill in a tax
declaration every year, even if you don't rent it out and pay a tax that is
based on the official value. Obviously if you do have a rental income you
are supposed to pay tax on it. If you would like to enquire about the fiscal
