Speaking to our Solicitor he is saying we can pull out of the Contract now.  As the builder has not stated an actual completion date on the contract, has given no Bank Guarantees and has not found any builders to finish the project and also sent a completion pack dated 14th December 2005 stating that "We would like to inform you completion will take place approximately by April/May 2006".  The Solicitor is saying that they are in breach of contract now!!  He sees no reason at this time that the courts should be involved to get our money back he said they have property, offices and assets.  Obviously if they refuse to refund then the courts would be the last option.

Our Solicitor has been asking for a Bank Guarantee from Urbasa but nothing has appeared.  If we decide to stay the distance they will carry on trying to get the Guarantee to secure money already paid and also to protect the amount they will want before completion which must be sent about two weeks before we sign.  I am definately not sending a penny without a Guarantee in place.

As everything we touch regarding this project has turned out wrong we are even questioning our own Solicitors instructions.  Can anyone else who has an independant Solicitor ask the question (Can we pull out now without being the ones who will breach the contract).  We dont want to pull out then 4 months down the line find out that we should have waiting until October 7th when Urbasa's contract runs out.

I phoned Palmera in Benalmadena on Thursday afternoon around 2.30.  We have paid 3,485.80 euros in agency fees in June 2003.  At the time I asked what this covered and they said Agency Fees + Solicitors + Insurance for the money paid.  I wanted them to tell me that again hoping they would say the magic word Insurance again.  Then I would ask about Guarantees but unfortunately their Customer Services Department only opens now between 10.00 and 1.00pm our time.  They used to be there all day.  So another wasted phone call I cannot phone during the morning.

If you come back and say that your Solicitor agrees with ours then I think we shall pull out now.

I HAVE BEEN TALKING TO A FEW PEOPLE THIS WEEK WHEN I SPOKE TO LAURA  ABOUT THE MONEY I HAVE PAID

I TOLD HER THAT I HAVE PAID 16700 UK POUNDS AND IF I CANCEL I WOULD EXSPECT THIS BACK PLUS 3.5 % PER YEAR LIKE IT SAYS IN THE CONTRACT

SHE SAID TO ME THAT IF I HAD PAID THAT MUCH URBASA WOULD ONLY HAVE AROUND 12000 AND THE ESTATE AGENT WOULD HAVE THE REST FOR THERE COMMISION

SO IN OTHER WORDS THEY ARE NOT GOING TO GIVE YOU THE FULL AMOUNT BACK

YOU WOULD HAVE TO CHASE THE ESTATE AGENT FOR THE MONEY THEY HAVE TOOK FROM YOU FOR SELLING YOU NOTHING AND IF THEY ARE NOT GOING TO PAY YOU BACK ITS ANOTHER COURT CASE

SOUNDS GOOD DONE IT  MORE CRAP TO PUT UP WITH,  THEN IT GETS BETTA

SO I GOT ONTO MY ESTATE AGENT TO FIND OUT WHAT MONEY THEY HAVE TAKEN OUT OF MY DEPOSIT AND THEY SAID NOTHING URBASA HAVE IT ALL AND THEY ARE TAKING URBASA TO COURT THEY PUT THE PAPERWORK IN 18 MONTHS AGO TO TAKE THEM TO COURT BECAUSE URBASA HAVE NOT PAID THEM THERE MONEY

THEY COULD HAVE TOLD ME THIS 18 MONTHS AGO

ANY HOW ENOUGH OF MY MOANING AM GOIN HAVING A WHISKY OR TWO
