There are a number of us questioning the appointment of AEA and the current high levels of community fee - there are some very good postings under the thread which is headed about pulling out and getting money back on a phase two apartment - worth reading - then please continue the debate here so others can easily find the information and join in..

I have a detailed list of all the costs which make up the charges for phase 1 this year. As i am new to this game i am not sure whether the charges for lifeguards or security or anything else for that matter is value for money. Equally on my recent vists I have not seen sight nor sound of security or a lifegauard...so why are we charged for them??  has any of our friends here who live onste seen evidence of these ?  I would be happy to pass onto a copy of these costs..

JC1, can you send me the list that make up the community costs? I am president on a small community in Manilva (now in my 3rd year as President). I get monthly budgets/costs etc. for my site arnd so I can make some comparisons if it helps. I have always questioned costs over the last 3 years so have some experience. If you send me a private email with telephone number UK or Spain I can call you to discuss as I get free calls to UK and Europe !! Hope this helps,

Hi

It appears that AEA have taken the quarterly charge for maintenance from my current account in Spain,although i have no idea how they have gained my account details as I wouldn't sign thier DD when asked at the signing for the apartment,maybe the developer has given them the details! I will be making the call tomorrow.

I have disputed the costs and services given with them at time of signing for my apartment and it appears there is nothing I can do about it.The pool isn't finished and i don't understand why i should be paying for security when the developer must be paying for the site security as they are still working on it.

Has anyone else had a similar experience and is there anything i can do to reduce costs and receive a better service?

I spoke with my administrator yesterday about community fees and the requirement of the builder to pay the shares on the apartments they own. She is very knowledgeable on Spanish horizontal law and does a radio spot on radio station REM on property law with her husband who is a lawyer in their administration practice.

 

The net is that all owners including the builder pay fees based on the quota ownership of the apartment (i.e. its size as a share of a block or a community) you can find this in your private contract and this will also be in the escritura  the title deed.

 

Any owner has the right and can demand to see the accounts in full so they can see who is paying what and where and how the money is being spent. Also any owner can ask for a full list of apartments and the quotas associated with them and who owns them.

 

I have not completed yet so I cannot make this demand, but others who have can ask.

I've asked my lawyer tolook into this and this is her reply:

It seems is running some information that has been misunderstood, as you are
not the first of my clients who asked me about the same.

Phases under construction, of course has not costs as maintenance for
gardens, pools, light and water (excepting the light and water necessary to
make the construction that are paid separately).

So, initially when the first phase was finished the owners of that phase
were paying the community fees for the maintenance costs of the first phase
only. As the others was not built so no costs was faced.
Once the second phase has been finished, the owners of the second phase will
be paying the fees for the maintenance costs of the second phase, and their
proportional part of the general fees of the complex that has been
finalized.
In resume, you are paying the fees for the phase 1 and the proportional part
of the costs of the second phase as part of the complex where your property
is located. And the owners of the second phase are paying the fees for the
second phase, and their proportional part of the general costs of the hole
complex finalized included the first phase.
As soon as the third and the rest of phases will be finished, again the
general costs will be shared between all the owners of the complex. Until
the moment that everthing is finished and all owners will be faced the
general maintenance costs of the hole complex.

That is the way it must be done.

I aked my lawyer who gave me the same reply exactly ...so one thing that can be deduced is we have the same lawyer!!!!

I received a letter from AEA saying that as 3 more blocks were now released from phase 2 , making 7 in total, my quarterly fee was reduced by about €128 from jan1st

Has anyone managed to get full details from AEA regarding their manegment of the development  and the costs which are being paid for, but not provided (pool & security etc)

I set out below my email to them of 14th December which remains unanswered despite a reminder.

As the owner of apartment               I would be obliged if you could email a copy of the minutes of the first and second meetings of the Community and advise me of the names of the President, Vice President and Secretary
 
As the majority of the owners the are from the UK the minutes should be available in an English translation, in accordance with the provisions of the Horizontal Property Act :-
 
If the person calling the meeting knows that not all owners have a common language, he should arrange for an interpreter to be present.

We have just completed on our apartment, do we have to email AEA informing them of it or do they contact us?

Does anybody know the fees we will be required to pay on a 2 bed 2 bath 1st floor apartment?

i sent a similar request to the same person and as you have not yet received a reply. i wanted a copy of the accounts to date ...to see what has been spent on things we have not got,eg security.

Hi all. Set out below is the 2006 Budget for blocks 1-4 (totalling some 203,916 Euros, which is then divided by the 72 apartments in these blocks and futher aportioned by apartment size)

Article 28 states the Community year end is closed at the end of the natural year, a surplus or minus from the estimated budget (shown below) will result in a recalculation of the following years fees.

As phase 1 only completed half way through the year, one would expect the estimated 2006 budget costs to be halved  (items such as garden maintenance, water, electricity, security, insurance etc)  Other costs such as life guard (9,000 Euros) should be excluded and carried over as a community charge deduction for owners of blocks 1-4 for the following year as this item was paid for in community charges but not spent.

As additional blocks complete it would be very useful to know the itemised budget breakdowns of additional phases so that costs as a whole can be analised. I have not got the breakdown of the 2007 budget. Could someone post them here. Are these costs now split between newly completed blocks. Do the new members of phase 2 have the same estimated budget list? If not, could they also post them as I understand from my solicitor that phase 2 is completing in around 3 weeks.

2006 Budget... (all figures in Euros)             As a UK Building Surveyor I have given brief comment on certain costs listed below and welcome comment on other costs outside my expertise. I have not yet seen the years accounts but am surprised to read that John only had a 128 Euro a quarter reduction. P.S. Does anyone know the date for this years community meeting with AEA?  

General Maintenance 31,200     This seems a very high estimate considering the buildings are brand new, would expect this figure to be very low.                              

Building cleaning 35,784     2-3 opperatives for a day a week for six months. Have not as yet calculated what this contract would cost. Anyone got any accurate costs  

Water 500.00     Figure seems low! considering the number of  garden sprinklers 

Electricity 3500              

Security 42,000      27k a year for a night watchman seems a high budget estimate

Life guard 9,000     

Sanitary Control 3,400     Dont know as yet what this includes

Lift maintenance 23,040     Estimate/contract seems very high for around a dozen new lifts

Lift telephone 3,300 

AEA Admin 7,512    Have read negative message board notes about AEA. My solicitors comments were that they were very organised.   Their ability to control contract costs, get value for money and provide adequate cost information is absolutely vital to all in DV. Communication about construction times seems poor though. The bottom pool was closed for 4 months for minor alterations instead of 30 days as stated and is still padlocked. No snagging seems to be done for communal areas as I can see many faults. Who is doing this for us???

Insurance 2,800

Purchase materials 1,000

Pool Maint 4,900

Garden Maint 30,600

TV & entry phones 1,000

Fire extinguisher maintenance 500.00

Office expenses 600.00

Bank expenses 400.00

Meeting expenses 1,000

Terms & conditions 1,160

Audit report 720.00

TOTAL 203.916

My gut feeling for the Audit figures (to the end of 2006) should be around a halving of the costs estimated (linking them to the completion date of phase one half way into the year),  a massive reduction in the actual 2006 maintenance spend estimated at 31,200 and a closer look at the cleaning security and in particular the lift maintenance costs. I look forward to meeting with AEA and the rest of you at some point. I hope I have not missed this years meeting. Please post the date.

All those who have completed have received the budget that Andy has posted.

However my point is that the minutes of the first and second meeting, together with details of the president and secretary etc have not been made available to anyone despite requests. In addition AEA are ignoring requests for accounts, calls for meetings, hording our post in the pigeon hole in their office and in general are ignoring the residents completely.

It is time that we took action to remove them and I suggest that if people are in agreement Maria de Castro be instructed to commence legal action to remove them.

What do others think ??

Michael 52....i like you have made similar request to Rosa at AEA with no luck. I have written to my lawyer for advice but in the end its the community who should decided as you say.  The problem i see for us at the monent is that I do not know who we can replace them with.. i am an occassional visitor and no experience with management companies in spain. If somebody knows of a better one then i have no problem with, in the first instance, threatenning AEA with expulsion unless they perform. I think we need an alternative then if we go down that route.
