Glad to see that you agree that: "We should now address views on both sides of the fence so those with decisions to make will at least have the opportunity to see the opinions of those that up till now have stayed beneath the radar".
As there are indeed those of us with decisions still to make, it will help us to understand your view on your particular side of the fence if you would care to elaborate on a previous post you made (see below) so we may have the opportunity to understand this particular opinion of yours. So what are you saying Jim - if I ask you the same question by pm, you will answer? Don't all readers of this Green Hills thread have a genuine interest in the development? Isn't it only in the spirit of the forum to post any information you feel is of an 'urgent' matter?
What happened to your statement " I look forward to all those that wish to post and please keep them fair, open...". Not being very 'open' yourself - still trying to maintain secrecy. However, as someone with a 'genuine interest' in Green Hills, I shall be sending you a pm to request the information if this is the only way you will impart with it.

Oh well - I tried.
Sent a pm to sunbelt and the result was that he's now deleted his whole post. Yet again a lot of hot air that blows nowhere.
After editing his post to death (five times), to just now delete it seems a lot of wasted energy to me. Jim, if you have nothing to say/share, why bother in the first place???
Anyone with any real news on Green Hills?

I assume most people already know, but in case they don't, the new draft PGOU (Urban Plan) is on view in Marbella and las Chapas.The Green Hills site is classified as suitable for development of the type "plurifamiliar exento'. I'm not quite sure what this means, my solicitor is looking into it, but many other developments in Elviria have been assigned the same classification. The PGOU will be on view until the end of September, after which the Town Hall will consider appeals before sending the final draft to the Junta for ratification.

The area of the abandoned upper blocks has been designated for "Adosados Unifamiliar", which are town houses or semi-detached uints, I believe. The area below and around the development, where I understood the golf course was to be sited, has been designated as green space. This message was last edited by Ian G on 8/10/2007.

Eureka - have finally had a (pm) reply from Sunbelt -
'The information and advice I have for you is that you change lawyers as your seems out of date if he or she is unaware of the problems you have with your development'.
So much for him saying (before he deleted it) that he is happy to share the information he apparantly has. Obviously prefers to keep it to himself and just taunt - though am coming to the conclusion that is how he gets his 'jollies'. Not really the spirit of this forum, is it?????
Ian - thank you for the information. I know the problem with the upper blocks at Green Hills was that the area was designated (on the 1986 PGOU) for semi-detached villas/townhouses only and not blocks of apartments. Likewise, the planned golfcourse was planned on an area that was supposed to be a public green area. The whole area was also designated to have roads and public green areas to enjoy - so whatever the outcome re. the lower blocks, it may end up with the same problems I have read on the La Reserva de Marbella thread (i.e. roads/roundabouts will be run all round and through the development, possibly making their security gate redundant!!).
Re. the lower blocks, will also make some enquiries and will post here. Unfortunately our lawyer is on holiday at the moment - won't be changing him, he is winning cases against the developer in getting monies back. As Sunbelt has already completed on his apartment, I know he doesn't need to change his at this late stage. His only interest in any latest news is to try and encourage people to join him in completing, and taunt those who haven't completed yet. Oh well, each to his own.

A new road seems to be planned leading west from the crossroads below the development, joining the N4340 somewhere towards Los Monteros. There do not seem to be any plans to continue the road running along the bottom of the development where there is currently a dead end. That's my impression, could be wrong of course.

We too bought in the lower blocks with No Bank Guarentee and have not been successful in the courts. the resolution of the high court was that no BG is not sufficent to cancell the contract, no LFO and illegal build even though an architect verfied it was so is still not sufficent grounds for a refund of our deposit. We are noe in the position that if we do not complete we lose our deposit, is anyone else in a similar situation and if so can you advise as to how we can recover our deposit or a least some of it.

Think most new this was going to be the case but this info was received today.
The general plan is almost ready and Green Hills is one of the complexes to be legalised. The only trouble is that the Spanish banks are not happy to lend at the moment.
Seem a double edged sword.
