I have just received this information by email from my solicitor in response to my query:
"
Last Friday morning I also heard the same rumour with another client we have in the same development. To that end, I have the confirmation that the First Inhabitant Licence has obtained the approval from the Town Hall, but it is still pending one last arrangement, which will be resolved shortly (I have not been able to get more accurate information since I am not the developers’ representative).
On the other hand, further to my meeting with the Town Hall, he has confirmed me that the access to the Avenida de Carvajal must be carried out. Nevertheless, it will suffer some delay due to the conflict between Adif and the Town Hall of Fuengirola. He was not able to tell me how long it will take, but he thinks this matter will be speeded up after the summer period. "
I suppose we could speculate until the cows come home as to what this "one last arrangement" is....
My solicitor had a meeting with the Town Hall people arranged for today so I guess his information is pretty much up to date. I suppose we will just have to eke out another week waiting for the big breakthrough!

It's good to hear that the town hall still demands a future access to the Avenida Carvajal.
Regarding the license I'm confused by now. Your lawyer confirms that it has 'obtained approval' but is still waiting for one 'last arrangement'. The information we got from Lawyers in Spain who consulted the town hall last Friday was that they had actually granted the license. They didn’t mention last arrangements.
We spoke again with Perla this morning and she reiterated that she still had no license. Our own lawyer (not connected to the above mentioned Lawyers in Spain) called us later today and stated that although the license was not in yet, she felt sure enough to try and make an appointment with the notary! This was based on her contact with the developer late this morning. Somehow she believes that the license will be in time for this meeting. On earlier occasions when these rumours broke out she was quite reluctant so somehow she is also convinced it’s imminent.
Sorry for a possible false alarm. I always try to check the facts as best as possible but I give up by now. I won’t mention a thing about the *** license until I’m actually sitting at the notary.

Maybe we shoul change the title of this thread, to something like"We would like to see the first Occupancy License Granted" :o) Even though we are in phase 2 and therefor not suffering with delay as all of you in Phase 1, I start wundering if we will get our apartment this year (expected hand over in November).
All the best to all of you missing a place to stay - vacation or permanent.

Hola everyone in Spain and at home
We have been to see Perla today and the exact statement from her was as follows -
The town hall has congratulated us and issued the first occupancy licence but we just need one more signature???........Also we have ´booked` ?? the notary - most of them fly away this month but we have one.........just in case so everything is very close - lovely lovely young woman but we now wonder if she can even lie straight in bed
We actually walked away and thought maybe not this year then...................-We did take a leisurely stroll up to the site and there were a few workmen painting railings and installing white goods - most blocks seem to be locked up now there was still work going on at the back doing the road and absolutely nothing happening on phase 3
Anyway all Don Juan nearly owners who are in Fuengirola at the moment or are arriving soon see you all in the Calypso bar on the 27th- 8.30 as arranged -now that is something to look forward to
Hasta Luego
Maureen and Chris

Dear Max and Saskia and Everyone.
Delighted to hear the good news. We wish we could be in Fuengirola for the 27th. Unfortunately we are back in wet and windy Ireland. Hope everything goes smoothly. Best wishes.

Well I suppose it's good to hear that all they are waiting for is a signature.......sorry that I won't be over for the Calypso meet up. Will be over on the10th Sept alright but even if they have a notary booked he can only deal with one at a time.... My solicitor mentioned it could take 15 to 20 days to get electricity & water connected which is essential really to get snagging , cleaning, furniture install etc done. Nevertheless each day now edges us a little closer to the all important big day & hand over of keys and excitement is certainly building.....
Hi Monica & Seamus,
What part of Ireland do you hail from and which apartment will you be occupying in Don Juan?
Regards
Gay & JB

C an’t resist bringing Gericoms cows home. For weeks I have been wondering why they worked so hard at the newly built stretch of road, while doing nothing at the existing carriageway. This existing road has never been used (roadblocks forbid it) and it had some clearly visible safety shortcomings. I kept on remarking to Saskia that the open put holes and some missing crash barriers could well turn out to be a problem for our license.
On inspection today this clearly is what the town hall ordered. They are installing lots of crash barriers, painting them yellow etc. Let’s hope that this is the ‘last arrangement’ as the work is as good as finished.
Regarding utilities: we have been told by the responsible companies that connections could be formally arranged in a few days. For electricity there is the additional need for an electrician to have access to your home. This could take longer as most work men are on holidays in August.

Hello Offaly,
Good to hear from you. We were over in August and met up with Max and Saskia. It was great to put faces to names. We are in bloque 5 Phase 11 and really looking forward to completion, maybe we will get there for Christmas although we hve been told Feb. 2008. We liv ein Clare andhave been here longer than we care to admit, However, we always hasten to add that we are from Tipperary. Good luck over the next few weeks we hope things will sort themselves out. Cant wait to get there.

Hi, I am new to the thread and was full of hope when I read the lead title! Any news on occupancy license? I am in Don Juan I and live in USA. Counting with your greater proximity for guidance.

Hi Boricua,
Although we live very close to the Don Juan complex we don't have the definite answer. It's rumoured that we are still waiting for a signature to open the access road. The responsible person seems to be on holiday. The moment he or she signs our developer gets his license which is already approved.
By the sound of it we should be there within a week, but it wouldn't be the first time a new delay pops up. Fingers crossed.

Hi Max,
Will keep fingers crossed as well. I am in Building 8 and need to coordinate all matters from a great distance so lead notice is key for me and guidance from those who already live in Spain a blessing! Thxs.

We just called. Perla says she has the license. It came in yesterday afternoon. This is the first she time she said so, so I really must be true!
They will start scheduling appointments for completions on Monday.

Hi, Just a note to say my lawyer has phoned me, informing me that the documentation is all in hand and has an appointment to sign for the apartment on Wednesday.
