Hi

We have just been in our appartment for the first time. We spoke to the salesagent from the real estate compagny where we bought. He told about his own place. They had the same problem with the size of the pools. They had made steps on one side of the pool. That was how they managed to cut off squaremeters. I do not know about the costs - but maybe it could be a solution.

He also told us that his compagny had stopped cooperating with the developer of Don Juan, because they had too many unsatishfied costumers. He hoped to put more pressure on them to fix the problems. We can only hope for the best.

The weekly meeting is today rather than Wednesday so that the lawyer can attend. Max has made the committee aware of the importance of the pools for holiday makers but the licence is not in the control of the community. They are doing everything they can to put pressure on the town hall. I don't want to be unduly pessimistic but I have heard of pools not being licenced for up to 2 years after the FHL was issued.

I can't imagine the police will come and arrest you Irene if you use them in the meantime but neither do I think the community can be seen to facilitate their use before the licence is issued even if it is "at your own risk".

Very tempted to dip a toe in the water last week but decided against as not sure how hygienic it was.  I know the filters are running but what about chemicals to kill off any nasties? The sea was VERY COLD but thought the pools, because they're sheltered, may have been slightly warmer. Only got toes wet in the sea not foolish enough to go in any deeper in March. it needs to get VERY HOT before I venture into European seas.

I assume that the same people doing the gardens will be maintaining the pools or will it be another company?

Hi Sonia, Yes it is the same maintainance company for the pools as the gardens. I have not seen them adding any chemicals or testing the water but then why should they when the pools are not officially in use.

Whilst it can be understood that the Swimming Pools are not in use as no license has been obtained, waiting for the inspection by the Andalucian Health department.                                                                                                                                                                          Has the administration done research and an assessment or interpretation to ensure that all steps have been taken to ensure the licence is granted                                                                                                                                                                                                            and the regulations introduced by the Junta de Andalucía (Andalucía Government) which took affect from 1st January 2008 are covered:

Children’s pools are those intended for use of children under 6 years of age. These pools should be nodeeper than 40cm nor have slants or slopes of over 10%.                                                                                                                                                                           Children’s pools should be
totally independent so not to allow children to gain access to other pool areas accidentally.
Life Guides A minimum of 2 lifeguards are required for pool with a total water surface area of between 500 and 1000 meters squared, or 1 additional life guard per pool or per fraction of 500 meters squared.
Are the fences around the children’s pools, within this regulation, and what is the total water surface?.

All swimming facilities for collective use with a total water surface area of 200 meters squared or more should have a duly qualified lifeguard. For swimming facilities of between 200 and 500 meters squared there should be 1 lifeguard.

Ken the short answer to your question is no. Max and I asked Maximo about this and he said that it depended on how Fuengirola Council interpreted the regulations so we should wait and see what restrictions were imposed and then deal with them after that.

   Sorry for delay in answer, but have been away, the regulations produced by the Andulacia Government  quote,  "greater than 200m2 "

 which I interpreted as  200 metres squared.

As our pools were built before the 1st of January 2008, does that mean we only have to comply with the old regulations, or also, did we apply for the license before the 1st of January 2008, and does this make any difference.

Hi Ken and others,

The English version of the rules regulating pools are just a partly translation from the original Andalucian Law. They skip details like ‘if two ponds which are below the threshold are near each other then….’ Etc. Unfortunately the small print is important in our case so let’s wait until we have an update from the townhall regarding the current status of the pool license. Is it applied for, what are the obstacles etc etc. Our administrator has to find this out independently as the developer’s information is not too be trusted.

Any more news on the pools.

1) Will we need lifeguards

2) Are the pools cleaned regularly at the moment.

3) Do we need a key to get into the pool area. If yes, how do we get one for each pool.

4)  As our pools were built before the 1st of January 2008, does that mean we only have to comply with the old regulations, or also, did we apply for the license before the 1st of January 2008, and does this make any difference.

Hi Westport,
The moment we get a license i will certainly report it. Only then we know what the requirements will be.
They are sort of cleaned at the moment, but I'm not sure of the water quality. You don't need a key; it will be opened and closed by the maintenance staff. I assume the 2008 rules will apply for us as we only now apply for the license (the builder should have done that).

Hi

First i would like to say a big thank you to MAX for all his hard work, especially on the Sky which is a real bargain at $195.00 euros for the connection.  Max can you let me know when the pools are opening again as i have guest there at the moment but they were locked earlier but later in the day people were in one of them.

Unfortunately I can't answer the pool question. The opening times seem erratic to say the least. See the Community matters thread for some background.

Can anyone confirm whether the pools are now licensed and being cleaned regularly. I just wondered whether they are safe (health wise) to use. Has the supplier of the water been resolved or are you still using the builders water.
