Hi Bilcar and JPD, Yes I am confused and baffled as to why Urbasa require our details again, it was roughly explained that puchase prices are required and they need to know the difference to the investor, which none of us are privey to. I have another meeting with Urbasa next wednesday hopefully with my own interpreter. I having been an Estate Agent for the last 20 years am very perplexed with this situation and the mechanics of the intended transaction.
If there was and evidently is a private investor who bought the entire block, surely he would have a contract with Urbasa, we then have a contract with him as the new owner, which I would of thought Urbasa would have a contract with the investor to complete works. Those who need a mortgage who is the current owner ?
I also donot understand the cash difference and why Palmera are being so obstructive, I will try and call them later but to little avail I should imagine. If any of you have Skype my user name is michael.barrett33

We also spoke to Urbasa today and asked the same questions and was told the same answers, (spot on Vijam) but when we spoke about canceling we was told that Urbasa are not responsible for the full refund amount because Palmera are holding some moneys,plus informed us it will be some time before pay out due to the lack of funds. With regards the contract we then phoned palmera property and accused them of fraud they replyed you have the contract and it is clear in black and white.
When reading the contract around second paragraph it clearly states that Hannia Melloul is the owner, we have all been had over and can just hope that the foreign investor has good legal people that are on the case for completion.
Urbasa have been greedy during the property boom and have money problems but the real let down and the people to point the finger at is Palmera property they are cheats and scammers and we hope they get what they deserve by shattering so many peoples dreams.

Warning, this is a long and probably boring message but I just want to compare contracts. Our contract starts with :-
MR JOSE ANTONIO ARIZA SEVILLA, of legal age, single with notification address in Elche (Alicante), Calle Reina Victoria no 15-Entlo, holding spanish ID number DNI 47.065.227-M.
Acting in the name and representation, as the sole administrator, of the development company PROYECCIONES INMOBILIARIAS URBASA S.L, holding spanish tax identification code CIF B-92387174 and registered office in c/ Reina Victoria no 15 Entlo. of Elche (Alicante), by virtue of Deed authorised by the Nortary public Mr Juan Manuel Clemente Gonzalez, on the 29th March 2001 (with protocol number 465) which entitles him for this agrement. (Hereinafter the Seller).
Sorry this is really boring reading but I just wanted to know if eveyone's contracts was the same.
On the back page, the signature has been singed by D Jose Antonio Ariza Sevilla and above it, it says LA Vendedora Proyecciones Inmobiliarias Urbasa SL.
The covering letter is on Palmera headed paper but the contract is on plain. The letter says that the enclosed is an original and copy of the contract signed by the building of the property. We received this May 2005.
This to me, means our contract is with Urbasa, not Palmera or this other third party.

Sorry, me again. Just going through more paperwork and prior to getting these contracts which we recieved May 2005, we got a letter July 2004 which outlined the fees and deposit etc and the top of the letter starts with what JPD said earlier
"currently property of Hannia Melloul to whom Palmera Properties wil, on your instructions deliver all payments received, leading to the formalisation of the private contract between the buyer and the seller. Please note taht all amounts paid by the purchaser are passed to the devleopmer names above."
Not sure now who we are purchasing from, Hannia Melloul, Jose Antonio Ariza Sevilla or Urbasa.

our contract is as your last message, we agree who is the contract with?
Another worry is if the property did get completed (big if) who nows what might come out of the wood work then. Plus if builder does not have all our deposits do you think the third investor has the rest or palmera.
who do you trust.
We think the builder has spilt the beans because they are pushed in a corner due to completion date around the corner. Palmer being very quite keeping head down hoping we are all going to go away. what a shock they are in for.

Yes, we have got the same Contract and letter from Palmera. The contract also states that 'The Seller' (Urbasa) are the owners of the land. We also have a Reciept from palmera stating the amount that we have ''Paid The Builder'', who ever that may be?

Hi Mikeb or glynndeakin, can you post that e.mail that we got from Ainhoa on here? We have been trying but cant seem to get it on. I know all the main points of it have been mentioned, but have had a couple of private messages and dont really know how to attatch something to a private message on here??
Sorry guys, so if either of you could get it on here for others to see I am sure they would be interested.
We had another email from Ainhoa today, saying they are still looking for a builder and the site IS STILL 90% finished!! Dispite all the damage eh?!

In relation to the purchase property in Amarion III, situated in AlmoradI (Alicante), we hereby come to you asking for your apologies and forward to you once again an explanation, in writing, of the reasons why there has been a delay with the execution of the works at the building site.
We are sincerely sorry for the delay and the inconveniences caused towards you. Please understand that this situation is also causing us important problems, not only our relationship with you has been affected but also important costs on the site and as a consequence we are now suffering those delays, which we are presently dealing with.
It is true that completion date of the dwellings of this development is of 36 months as from the date when the works were initiated. We understand it is an unquestionable issue, but we would like you to be aware that the delay on the execution of the works has been a result of a transitory economical situation undergone by the company URBASA, however, as from various months ago the company is in constant negotiations in order to reactivate the execution of the works and finalise the building site as soon as possible.
To this date, we can inform you the building site in itself is at a 90% execution stage. As soon as the works are reinitiated, which we would like to occur within a short period of time, only four months of work at the building site would be needed in order to finalise the building. These are the latest details passed on to us by the constructor and of which our technical department agree.
In order for us to carry out our internal audit, which we are obliged by the I.S.O. 9001, we kindly request you send us copy of all documents dated since the initial of the purchase of the dwellings (reservations, payment receipts, contracts whereby it reflects all the participants involved in the purchase, etc...)
We apologize once more for the delay in the completion of the dwellings. At the same time we thank you in advance for your collaboration, patience and consideration. We trust beforehand you comprehend the situation undergone by the company, which has caused us to reach this stage, therefore, we compromise that within a short period of time we shall solve this situation, since it has been Urbasa’s will during all this time to comply with the handing over of the dwellings.

Hi All,
Just remembered somthing Palmera told us when we viewed the site for the first time and saw the model in Urbasa's window, they said that they weren't selling all of the properties, the builder was keeping some back for themselves to sell. was anybody else told this? don't know if it has any relevance because none of them are finished anyway.

In introduce myself. I am Louis Butler and I am very happy in finding this web page and able to communicate to all that are in the same boat as myself! AT LONG LAST!
I have been reading all your messages and I have also gone through the same situation. I bought an apartment in Amarion III, aprox. in 2003 through Palmera Properties. I am very concerned because the time has elapsed, the contract is almost due and no mention of handing over my apartment. I also try and contact Palmera but no reply, therefore I am also stuck. I paid all my monies to Palmera and now they dont want to help me! All I know is that I signed a contract through Palmera, with a so-called Hanania Melloul. I have been able to find out that he purchased a great number of apartments and that these apartments were re-sold through Palmera. I had to pay Hanania a certain amount of money considered as fees, so that I could buy this apartment. Now I am confused, to whom would I have to claim the amounts I have paid? It is to Urbasa, Palmera or this so called Investor? Has anybody else signed a contract with Hananai? I am desperate in finding more about this. Please email me at: louisbut@gmail.com.
