Just learned today that there is a problem with the footings on two of the blocks under construction and Aifos are rectifying this..This is not Derby or Brida. one is Espuela I believe but will confirm later.
Aifos are attempting to have them placed into 'phase 2' of the development. If they are able to do this and Mijas is happy there will be no danger to occupants of phase 1 then I believe it is Aifos intentions to complete 4 blocks and then attempt to sort out problems with 'phase 2' blocks later. I have spoken to a lawyer and apparently as long as Town Hall happy on safety aspect such as access by lorries to site, movement of cranes etc. phase 1 can be released- they may take some convincing! I can only speak from the knowledge that a friend of mine was in a similar situation and his development had only partial planning permission and was released in phases with occupancy licences granted on completion of each phase, this was also after the new law on occupancy of developments came into force. It will all depend on the town hall as even the Junta have failed in attempts to stop certain golf developments in the interior.
