Hi all

After reading the posts regarding the recent rain and subsequent flooding, and after taking advice from another EOS member we e mailed our MASA agent to ask if:

1. our property was flood free

2. What happens when we take posession or our property and the same happens again?

This is the reply we got from her:

Dear Nigel & Stella,

Thank you for your email of the 16th October.

I totally understand your current concerns regarding the recent flooding in
the area. We are going to visit your property either tomorrow of Friday, and
I will contact you with the result of the visit.

There has been much coverage on Spanish television recently regarding the
heavy rainfall, which has affected many towns and cities in the country. The
last time the area was flooded was in 1956, and I have been informed that it
is an event which happens every 25-30 years.

Every property built in Spain has a 10 year structural guarantee, covered by
the constructor. If heavy rainfall occurs in the future and your property is
flooded, neither the builder nor your insurance company would be responsible
as it is classed as a natural disaster, and so the matter would be dealt
with by the Government, meaning, that you would have to "denounce" the
Government at your local Town Hall. A representative from the Government
would be instructed to carry out a survey on your proper and the damage
assessed.

I hope the above has eased your concerns. As mentioned previously, I will
contact you when we have checked your property, which may not be until
Monday, if we visit the site on Friday.

WHAT DO YOU MAKE OF THAT?

Justin / Fellow members, what does this "denounce" thing mean?

Is it worth taking out insurance or is it worth the risk and take things on the chin if the worst happens or would we be covered?

We would be interested to hear comments

If you sue somebody in Spain you denounce them and that`s what ot means, taking them to Court

The note is not actually correct because if the construction does not have adequate drainage in place then you can actually bring an action against the builder for neglegence but getting any compnay to Court in Spain can take years and be expensive

The cover given under building insurance, policy which covers you for 10 years for construction problems does exclude natural disasters but you should but you should take out ypour own the building insurance anyway

The problem comes if you have not completed and there is flooding because then you are stuck and our advice remains, never complete on a property until after you have had it inspected, exactlly for these reasons
