A house was demolished today in Vera by the Junta de Andalucia, despite having Vera town hall planning permission. The house was over four years old and was used by a British pensioner couple. They had received a letter two weeks ago threatening them, but their lawyer said not to worry.
This morning the power and water were cut. The Guardia arrived and said that at 3.30 precisely, the bulldozers were coming. Neighbours helped empty the house of possessions as the time crept nearer. At 3.30 the house was knocked flat.
The demolition order was actioned by the Ministry of Public works of the Junta de Andalucia.

i gather the husband has a heart condition and they are let to fight through the courts for compenasation. is this yet another example of spanish jusctice

Has anyone heard of anyone that has had their property repossessed due to non payment of mortgage. I have had a property in La eserva De arbella for about 2 years, never really planned to keep it for that long. I can no longer pay the mortgage and cannot sell because it does not have an occupancy licence even though my lawyer told me it had been granted and forced me to buy with fines for late payment. The bank lent me money on a property i am unable to sell and has already cost me a lot of money, I have missed one mortgage payment and have decided to stop sending money over as it seems this will never end and even if it does get the licence Idon't think I will be able to get back what I have already put in. How long do repossesions take? Can they force the electric and water to be cut off? Can they come after assets abroad? I really need to speak to a spanish lawyer as I don't trust my own and have no money left to get a new one I am kind of stuck?

Sorry to hear about your situation. Properties here are still changing hands, albeit slowly. I know at least two properties near me in manzana 3, that have been sold in the past year. Local estate agents are still advertising properties here for sale. The developers have just started a new campaign to sell properties. There is a lively rental market here with some owners having almost full bookings for the coming season. I don't know when you last visited LrdM, but things have improved a lot in the last year. I live here and its the best thing I ever did.

I thought that new laws state that REAs are no longer allowed to sell/advertise properties that do not have all the legal titles in place, including LFOs. I feel very sorry for people like Paolo who were given bad advice by disreputable lawyers.

It seems the junta have there own agenda, i felt quite hopeful with la reserva in the new town plan and our developers coming to an agreement with the town hall. It now seems irrespective of the work being done on the town plan the junta may have other ideas. has anyone heard of this junta demoltion list or our we all on it. Does the junta really want to turn marbella into BERUIT
can anyone shed light on this and any news of what is happening the the licenses

Demolition respite
The Andalusian High Court (TSJA) has brought relief, at least for the time being, for owners of illegal properties in Marbella whose demolition had already been ordered. The court has agreed to postpone the execution of the sentences already passed until the new development plan (PGOU) has been approved. So far there are at least 38 cases (affecting around 1,000 apartments) in which the court had previously ordered the Town Hall to carry out the final sentences passed, in other words, to demolish the buildings in question
Hope this is of comfort to those who may be worried
