Hi - sorry to pass on depressing news. My new solicitor has been verbally advised by Aifos this week that they expect to complete the development by the end of 2008.

Dear All,
Heard on the local radio today that the Fuengirola Town Hall have refused to grant building licences for certain buildings by Aifos in Torreblanca. There were no specifics as to which part of the development is deemed illegal, but I would suggest anyone concerned contact the Town Hall asap.

Does anyone have up to date photographs of the site that they could post on here? The photos on the aifos website are from january and I just wondered what, if any, progress has been made. Thank you.

Ihave received an e mail from my solicitor this morning regarding the build and have attached it ,it does not sound very promising .does anyone have any views
Re.: Cortijo Torreblanca, Bloque A-2
Dear Mr. Ajib,
Further to our latest communications with regard to the purchase of the above mentioned property, please let us inform you that according to the information provided by the Town Hall in the meeting kept last Monday 3rd of September, the building work in blocks 1, 2, 3, 4 and 5 have been paralyzed. The reason is due to the Project which was approved and presented by the promoter in the Town Hall and which didn’t adjust, because one more floor (without authorization) was built and therefore the corresponding disciplinary proceedings and re-establishment of juridical disturbed order has been opened at court.
The Town Hall has requested to the promoter to pull down that new floor in order to carry on with the construction, as that floor is at the moment in framework, but the promoter has refused their petition. Consequently the Town Hall won’t grant the necessary First Occupancy Licence if the promoter follows their pretentions.
The promoter’s intention is that this new modification carried out, is included in the Regulation New Plan, but according to the Town Hall, the mentioned PGOU (regulation plan) won’t be approved until unless spring 2008 and they do not believe that the mentioned Plan will be modified or authorize the new floor.
Nowadays, the promoter and the Town Hall are revising other possible solutions, but those are just conversations and nothing it´s clear, as of today the Town Hall only has allow to the promoter to carry on with the building work on the rest of the blocks.
We would be very grateful if you could please advice us of your decision.

Oh dear! I was under the impression that the town hall had said that there is no problem with Cortijo de Torreblanca so this news is rather surprising. In some ways it is completely unsurprising as it just follows the general trend of complete and utter ineptitude that we have fallen victim to. If indeed Aifos have built outwith the planning consent you would expect that the wishes of the town hall would take precedence over those of Aifos but if this person is correct another long period of debate and proposal followed by yet more debate and counter proposals will start again in the Spring. I must confess to being completely disenchanted with almost everybody that I have come in contact with in any official capacity regarding our purchase of the apartment. My solicitor couldn't give a tinkers cuss; the agent that I purchased the property through refuses to do any work woth Aifos as they will not pay him and as for Aifos, I only wonder what condition these properties will be in if we ever manage to take up ownership. That the Spanish government allows this business behaviour to carry on is absolutely disgusting. Banana Republics and tinpot dictatorships spring to mind.

what a complete and utter shambles,I don t understand why the town hall would say,
in july that there is no problem with cortijo,and now only 2 months later there is this ,
problem of an extra illegal floor suddenly coming to light.
I now think I have made probably the biggest financial mistake of my life.

If you look at the photographs on the aifos website which were taken in january of this year, one of the blocks, A2 I think, was the only one that did not have the upper part of the construction completed. If that is still the condition of that block then it suggests that there ihas been a breach of the planning consent. This could drag on forever and perhaps one reason is that Aifos are having problems selling some of the apartments and so are quite content to wait until the market improves. It's just a thought but I'd like to think that behind this complete and utter incompetence there lies method rather than just the bovine stupidity of an organisation that I wouldn't trust to erect a tent.

I know we all seem to be acquiring information from different sources however I thought I would post the latest that I have received from Casa Blanca
Dear Andy
I am contacting you with regards to your email of the 11th of September. I
have just received a reply from Aifos and they reckon that completion will
be in about 9 months time. They are still in process to negotiate with the
townhall regarding the building stop. They also told me to check again in
about one month time, then they might be able to give a more exact
completion date.

Alison, I read the information with interest and would suggest even at this stage WE ALL consolidate our interests in Cortijo in case we are presented with the same problem on completion.
Once again I make no apologies for suggesting we operate as one unit but it would be worth considering again how many of us there are.
Thanks to those who have sent me their details , I have had five replies to date, if nothing else it would be good to meet up after this is all over, put a "face to a message" so to speak,

The problem, Alison, is that on here there are only a few people who have bought in Cortijo. How do we reach all of the other owners in order to get agreement on the way forward? If one competent solicitor were handling the affairs of a large group then we would maybe have some success but because we are so fragmented there may be considerable risk in telling Aifos, individually, thay you are not going to sign. Basically the problem lies within Spanish law. Until they clear up the corruption problems and then focus on changing the law to make corruption and deceit much more difficult these situations will continue. We need a mole inside of Aifos to provide us with the names and contact details of all purchasers because without that we are in a very difficult position.

I have contacted Christine Mollet of Casa Blanca asking her if she would supply me with contact details of the other purchasers, or at least pass my contact details on to them.
If we all do this with the estate agents that we have bought through, we can probably reach quite a few more people.
I would be quite willing to use the same solicitor as others, if we could decide on someone suitable. I have seen in earlier messages a Rosa mentioned.
I definately think that it is time for a get together.

Rosa is the lawyer we and Tinker use and would suggest her to anybody looking to change we are also with Casa Blanca.
As I said I have just six people (including myself) who have contacted me. Your suggestion is a good idea, the more the better.

hi andy,
I to use rosa in los boliches she seems pretty switched on,I think what is happening in terraza torreblanca,
is normal practise as far as aifos are concerned,but you are right we all need to get together now and just ,
use one lawyer. without the habitacion license the property is more or less useless.
so to exchange before the license has been granted is crazy.

I am going to telephone Rosa tomorrow (if I find her number in past posts) and get her opinion about changing my solicitor and have her handle all dealings with Aifos from now on. I'll have to pay my own solicitor in full I think but hopefully it will be worth it in the end.
