Hi yet again
Update. Sue & John ( Tinker) are buying a penthouse in Blocks B1 & B2 we have used Rosa from the onset and Tinker has used her on a number of previous ocassions.
We have just this minute spoken to Rosa she said it is the best thing for us if we used the same lawyer (not from her profit point of view I am sure) she is expecting contact from any of you that wish to engage her. She has also informed us that our bank guarentee is valid for another five years and she is investigating the current situation and will advise us to what action we should take soon.

I have just sent an email to Rosa, requesting to become a client.
Not sure whether this causes issues with our previous solicitor, but then again, if he was that bothered, then perhaps I would have heard from him in the past 2-3 years.
That is good news about the bank guarantee, another purchaser has been told that they don't have a bank guarantee, and even if they did, it would have expired by now.

Further confirmation regarding the "licence of Occupation, any lawyer worth their salt will not agree to sign off completion until this has been granted (Rosa is worth her salt).

This is the latest news I have from Christine Mollet from Casa Blanca:-
I don't really think that Aifos is pressuring clients to sign, they are basically offering this possibility and some clients prefer to sign now, being perfectly aware that the 1st Occ. Licence is not in place yet.
As Aifos has informed me, they are in process of reaching an agreement with the townhall regarding the building stop of and to contact them in approx. one month.

The Defensor Del Pueblo of Andalucia AND the Junta de Andalucia are now involved, asking questions about the overdevelopment in Cortijo. The Town Hall are, so far, refusing to answer any questions raised by both these entities ( BIG mistake ! ) and until the Town Hall provides justification for the alleged permitted overbuild, no further building works will be allowed to take place. Additionally, Michael Cashman MEP in charge of environmental issues ( he who denounced the scandals in Alicante last Spring ) appears to be interested in visiting Torreblanca in person to view the "destruction of the environment".
Seeing as I am only 50 yards from this development, and look at it every day, I can confirm that nothing is going on.
Take note Jim........this is fact, not some ugly rumour !

Well, that would be just the ticket for an illustrious MEP, a nice little jaunt down to Fuengirola at taxpayers expense, catch a few rays, enjoy a few wines and first class hotel, again courtesy of the taxpayer, have a whinge about the destruction of the ozone layer and the greenhouse effect caused by Cortijo de Torreblanca and then beetle back off to Brussels to think about his next soiree. Maybe somebody should send him some photos of that area prior to Cortijo being built and all he would see would be a few scrubby mounds with as much aesthetic value as the backside of a baboon! Never mind, it won't stop him.

I have just had a phone call from a spanish man, who says he has been contacted by Rosa, to start a claim of fraud against AIFOS.
He has told me that the contracts are illegal because A) they don't include a bankers guarantee, and B) the development has not been completed any where near the suggested time scales.
He is asking for power of attorney, and appears to want to get our deposits back. I personally would prefer the completed apartment.
Has anyone else heard from him?

Yes, I received a call from Juan Manuel a solicitor recommended by Rosa. I sent an e mail to Rosa last night and received a reply this morning saying that this was correct. I also spoke with Rosa this morning and also received an e mail from Juan stating what needs to be done if we want to go ahead. He is saying that they will take Aifos to court for fraud as they are using our money to set up other companies. He has about 7 clients who want to do the same and Rosa stated in her e mail to me that it would be more beneficial to do it collectively.

When Juan spoke to me, this action seemed to be to re-claim our deposit. I would rather have the apartment.
This has just been a huge leap forward, which I am not sure I want to take. I would rather have waited until we could have collectively asked Rosa what options we have.

From what I can grasp of this is Juan is using the reason, there is a strong possibility that Aifos may declare bankruptcy before Cortijo is completed and other allegations that Aifos are deliberately taken their time to finish the development at Torreblanca and using our deposit money to fund other businesses
He believes there is a case of fraud here and look to sue Aifos to obtain our deposits back .

As I'm not convinced the appartments will ever be finished, I am trying to get my money back via Jose Manuel Montiel ( different solicitor to the one that has been contacting you) at Marbella solicitors.
We are signing the power of attorney with a UK notary this week.

Further information I have received
The overbuild at Cortijo has been known to Aifos for well over two years as yet they have not spoken at all to the town hall with regard to this issue.
Aifos have a cash flow problem
Aifos have used OUR monies to finance OTHER business and this amounts to fraud which as I see is the case that Juan will be submitting to the courts.
With this additional information I personally will be in support of litigating Aifos in an effort to obtain the return of our monies simply because there has been no effort to resolve the overbuild with the town hall in over two years an this is no reassurance for the future.
