Am I right in thinking that NO-ONE has received this 3% discount we've heard so much of over the last few months? I know I've read it a few times. Have i imagined this? Margo

I dont have it however my Layer has been superb and his doing his best. They are trying to charge me an extra 7% transfer tax as I originally owned my property 50/50 with a friend who has now pulled out. Initially they said I have to pay €13,000 but we ave gone back and told them to shove it where the sun doesnt shine.....I think he knows the developer is doing all they can to make money. It does however worry me slightly if we all push too hard what this could mean in teh long run to our owners from a financial stability perspective around the whole complex

Bear in mind that this development is now owned by a bank, Cajasur, so we should not be too concerned about their financial welfare. They also have a lot of units still to sell, so having a lot of disgruntled owners on Phase 1 will not help them as most people read these forums now before committing themselves to buy and we can also fly-post the the later phases !!!

Well, I'm going to have to assume that no-one has set a precedence here, which is what my lawyer was looking for. The developer has basically told her to "shove it" and without anyone coming forward to say they have received it, I don't think they are going to shift from that position. I'll wait over the weekend and if no-one comes through with an affirmative on this one, I think I'm going to have to let it go. Shame, after all the inconvenience we've had. Margo

Margo, i got the 3% compensation. As you all know i have completed now Zzzzz sorry, but have seen it in black and white and have paid the balance. The 3% compensation was granted, definately 100%. It was adjusted and shown on my final breakdown before completion. There was some discussion about whether they would grant the 3% on the storage room too but was sorted.
Mike, we had to pay the 7% tax again too. Its a transfer tax that the developer is charging as the original contract is being changed from your friend no longer being on it and you going ahead yourself. We purchased our apt from an orginal buyer.
HOWEVER, we did come to an agreement about this and the original buyer (i.e. your friend), our agents who we purchased through and ourselves all paid a third of this. We kicked up a fuss and this was the compromise we were offered. Are you purchasing through and agent or property company mike? If so, kick some of the blame over to them as they did not tell you about it. But its normal, there is a forum on here explaining it if you look. Some developers let it go but most now won;t.

Sorry to keep harping on about this but it's worth a few thousand euros to me. My solicitor won't get in the boxing ring with the developer unless someone comes forward and tells me either the name of the lawyer who acted for them, or sends me a PM me with their contact details so that my solicitor can contact them. The developer is categorically denying that they have paid ANYONE a 3% discount (I know they have - I just can't prove it) and without that proof, I am stumped. Margo

my lawyers are Martinez-Echevarria, Perez Y Ferrero in Marbella. Hopefully they can confirm to you that they have clients who have received the 3% compensation. Ask your lawyers if they can make a general enquiry lawyer to lawyer without mentioning my name at first. Although i don't see i am doing anything wrong making it known that we got it.
