Have you all given your solicitors Power of Attorney? We haven't, and she's asking for it. Is that normal? I guess it must be. We're flyin out there tomorrow..........Margo

We found out about this yesterday.  It doesn't matter if you are there in person to sign, but otherwise you have to get a notary in the UK to sign the paperwork which then has to be stamped by the Foreign & Commonwealth office in London.  We have had to do this last year for another apartment.

Pdrich's reply is correct, you only ned to grant Power of attorney if you are unable to be present to sign all necessary paperwork.

We gave Power of attorney to our solicitor over a year ago & it has been fine, although the queue for the Foreign & Commnwealth office ( which is just by Trafalgar Square) was very long and you should plan on a days trip to get this done.  if you are going to go, plan on joining the queue at least an houyr before it opens, if you want to reduce your waiting time.

It involves getting in a queue, which you are given a number and when called, which is usually a few hours later, you present all the necessary paperwork & pay your fee....they then take this away for about 20 - 30 minutes, call you back & then grant the power of attorney.

I believe there are agencies that will do this on your behalf, for a fee of course, luckily I was fairly local to the FCO & had time on my hands, so it wasn't an issue but if you arent local & the fee isnt extortionate, i'd suggest using an agency for consular services, as it is a rather boring process

I also went for a coffee & bite to eat whilst I waited for my number to come up, which is what most people do.

Sean and others

 

I am letting my lawyer be Power of Attorney, he has now sent me a draft copy of this. Do i need to take this to the Spnish Consulate first and then the FOC office? Could someone explain excatly what forms,passport etc I will need to take with me

First of all, your solicitor has to send you the forms for power of attorney (which they may charge up to 200€ for, ours was included in the conveyancing fee). We went to a notary in Leeds with passports for identification where the notary signed and stamped the forms. The form was then sent to the Foreign & Commonwealth Office in London for the Hague Apostille to be granted. the forms were then returned to the notary, we collected and sent them by post to Spain. It cost us about £115 in total in UK fees for notary and apostille. It took less than a week from leaving the notary to it being returned, but I have heard it can take 2- 3 weeks depending on work load.

1) If you look in the Yellow Pages under notary, you will find some in your area. Check out a few of them as their fees vary quite drastically. You must sign the POA in front of the notary and take some relevant identification with you too as they will also take copies. May be worth asking him to notaris some passport copies while at it, you may then be able to use them in Spain instead of carrying around the original!

2) The notary should send the forms to the Foreign & Commonwealth Office, or you can take it yourself. If you decide to send it by post yourself, you may find it takes longer than getting the notary to do it for you.
