Thanks Steve; as ever you speak common sense!!You obviously know who I am to have received a message in the first place. I have no particular importance and know nothing that you all do not know. If I did believe me that you would all already know as my policy has always been to share information;positive or negative. I am simply a homeowner like everyone who invested in a dream and expects good customer care from the developer
My post is not to make people panic. My own situation is that I got san jose to draft a legal annex to the contract stating that they would return my money in december 2007 if licences had not been granted. They have not done so and I can not reconcile myself to holding faith with a company that dishonour their written word. This to me was definitive and cannot be looked at in terms of town hall delays and three month extension clauses; this was a black and white written contract which they have currently not honoured. ironically had they agreed I would have extended by contract and remained with the development .
My purpose of writing is that I feel people may want the benefit of knowing how the situation plays out. If san jose honour their agreement it will give comfort to those still waiting that we are dealing with a reputable developer who has our best interests at heart. IF they do not honour their agreement then it points towards their character and gives furthe information to those people who may seek to claim back from bank guarantees in the future.
The whole purpose of these forums is to share information and help each other in any way possible. that is all I am seeking to do
