Does anyone how this will work? I was told by my solicitor that it is up to us as resdients to decide on the service charge etc and to agree and run the site along with Polaris?

Most properties in Spain belong to a Community. This is an official body, recognised in Spanish Law , with rules on how they are setup and governed. It is more than just an Association...it is a legal entity...and is usually run on a day-to-day by a professional Administration Company who are appointed and paid for by the Community itself. The Community will normally have a President and several VP's Secretary etc. It is all set out in Spanish Laws. There will be a Community at Hacienda Riquelme which will look after all the non-Polaris interests.  PW will look after all their own commercial areas and the all the areas of golf course etc, and basically the rest is down to the Community to support and pay for by charging Community Fees to every property. There is usually an overlap period during the construction and  handovers where PW are effectively paying the lot, but it only last for a short period, so some form of interim fees (usually from when you completed) will be charged.

   Each property has a particular '%share' they will be required to contribute to the Community fixed in their deeds. The Community will look at all the costs of the resort (Security, Lighting, Gardening, Cleaning, Pool Maintenance, Communal upkeep etc) and determine the bugets to cover all those costs. This is then apportioned to each property based on many factors. So the Community Fees are determined by the Community to cover all those costs. It may be that there are a number of mini-communities, each with there own Predident elected by that mini-community which together form the Resort Community Committee with an overal president. It just depends how it is determined.
