Landlord Wants Us Out 6 Weeks Into 6 month Contract
The Comments |
We have a 6 month contract and have been in the apartment for 6 weeks. Today our landlord gave us one months notice as he has had a change of plans and wants us out to move in his friend. We obviously said that we have a contract but he says that he has the right. Surely not. What rights do we have?

I would need to see your contract. Please feel free to send it along.

If it is a standard rental contract, then both parties will have the option to terminate the contract, giving one month's notice.
Speaking as a landlord of Spanish property myself, this is what was in the contracts that our tenants signed.
We always sign the contract at our lawyers office, both parties are present and our lawyer explains the contract fully before allowing it to be signed.
You need to check through your contract as to what it states the landlord is required to give you in regards to notice.

Tenants do have a lot of rights in Spain - we signed a short-term rental contract prior to buying our apartment and the protection was very good, which reassured us. As said before, you need to check your own contract for the specific terms. If it is for six months, there may be a clause saying that the landlord cannot give you notice within that period unless you are in breach of the contract. Read it through very carefully!
Good luck.
