Code of Good Practice for Mortgages
You may notice in the press, or hopefully in your Bank, that a new Royal Decree has been passed in Spain on the 9th March (Ley 6/2012). This basically is a Code of good practice to do with mortgages which gives special benefits with the Notaries and Land Registries for the Spanish Banks who choose to adopt the code. It is to help mortgage holders in serious difficulties. The Banks do not have to follow the Code but are encouraged to do so.
Although a positive step in the right direction, it does seem to us that the guidelines are only going to help a limited number of people in this area, given the restrictions that they contain.
We note on reading the new decree that they encourage the Banks to help those in serious circumstances struggling with payment of their mortgage, by measures such as extending the period of loans up to 40 years and by reducing the interest rate for four years. They also can possibly give a rebate on the debt and accept a final payment in repayment of the debt. Customers can ask if they may be eligible for the benefits.
However, the Royal Decree states that the people entitled to these beneficial measures must meet certain conditions, firstly for areas with less than 100,000 inhabitants on the Padron such as the Orihuela Costa, the house must not have cost more than 120,000€ at the time of purchase (not what it´s worth now).
Also that everyone in the family unit must not have any work or income other than unemployment benefit in Spain, that the mortgage payment must be more than 60% of the unemployment benefit and they should be registered with both the Spanish unemployment authorities and Spanish tax authorities.
We are sad to say that we think this is only going to help a very limited number of people.
With the conditions they have imposed it is obvious that it won´t help Non-Residents, but it is a start and perhaps we will see in the future the measures extended to help a wider number of people. Let´s hope so…
