Bank draft when selling house

Congratulations on getting a buyer Camposol.

When we last sold a property we used a solicitor and he scheduled all our costs and retentions and gace us a balanced account There were  his fees, estate agents commission , plus valia, utilities and IBI from what I remember.  We then received a draft for the balance.

We are also tax resident so no 3% retention and our solicitor obtained certificate from Hacienda to prove it.

Please stop worrying and enjoy that moment when you get your hands on the bankers draft.

Campo surprised you are not aware of this.

I don't know  why you should be. The last time I sold was 13 years ago, I produced my tax return to the notary.  

It’s always a potential problem when one refers to something by a vague name which could refer to others things that which one meant, instead of saying precisely what one is relying on.   Maybe it’s a problem created by my legal background.

As for a cheque conformado or a cheque bancario and you will have the Bank´s guarantee on the funds you receive

Cheque conformado is a check of my own check book which has been stamped by the Bank after this checking on funds availability and blocking of the same. Guarantee is of around 15 days ( as stated in stamp) and it is not totally secure against embargoes or creditors´meetings.

 

Bank check: The Bank issues the check aqainst its own accounts after verifying the deposit I have made or cash I have showed. It has no time limit ( despite after first 15 days some judicial guarantees are lost) and, as being guaranteed byu the Bank, personal circunstances of the buyer ( who ask the Bank to issue the check for the purchase) makes no impact.
