We are hoping to move from Costa del Sol to Mallorca later this year and I have a couple of questions:

1. How much of a problem is it if the nota simple currently states that

a. there are 8 co-owners of the property?

b. there is a mortgage on the property?

The estate agent tells me that

i) there is only one owner of the property and 

ii) the mortgage details are out of date and the owner will close the mortgage once we are all at the notary.

2. Can my wife and I (both resident in Spain) be made resident in Mallorca at the time of signing at the notary and if so will this give us the residents' travel discount on the ferry from Denia to Palma?

GuyT must be having a laugh - don't trust anyone.

These are simple issues that a solicitor can answer - why not ask Maria who gets involved on these boards?  I do my own conveyancing in the UK but I would not dream of doing so in Spain.

The Notary can be helpful, but you really, really, really don't want to leave it to the last moment.

1. If the nota simple says there are 8 co-owners and the estate agent says there is only one, I would say the agent is probably an idiot. I think it's normal for the mortgage to be cancelled at the notary when signing - usually a representative from the bank will be there.

2.From what I can remember (moved from Mallorca to CDS 15 years ago) and based on my own logic (!!), the domestic travel discount for Balearic residents will be dependent on being registered on the padrón in Mallorca - so you will need an address and presumably proof of residence there such as a utility bill.
