Horizontal Property Law and Apartment Block Barbecues

Good Morning
Are there any Restrictions in your Statutues or the Horizontal Property Law regulating the use of Barbecues on Terraces. The Owners above the Studio Apartments are being incovenience with Smoke & Cooking Smells wafting into their open windows from these lit Barbecues at Lunch Time and in the evenings as late as 11pm

There is nothing specific or express about barbecues in the HPL. There is a generic reference which prohibits activities that create a nuisance or are dangerous.
The statutes as well as the internal rules of the community where I live do prohibit barbecues in an express and very specific way. However, every year the Administrators have to go around reminding owners and tenants about this and in the case of holiday tenants usually to no avail. I do believe it is getting better with the letters and phone calls from the Administrators. This summer so far, we have only had one instance. It is really awful when they do things like sardines!!

Inconsiderate neighbours can be an absolute pain. Most but not all are of low intelligence and they do not recognise anti social activities. It seems in your case they are not breaking the law, so that rules out the police. Community rules are usually unenforceable. All you can really do is try and have a polite quite word with them and explain the nuisance they are causing, if you get the 2 fingers up it’s close your windows and grin & bear it.
