My questions relate to the failure of law firms to take a more proactive stance on reporting back to the authorities all their findings that continue to compromise their clients and impact the rule of law and their rights to timely justice.
- When are law firms going to report back to the relevant authorities the scale of problems that their clients are being subjected to?
- Are you willing to provide this information to ensure these ongoing injustices are correctly recorded and monitored? Such as the number of clients who have been subjected to the following instances:
1) Those who have been denied recognition by the judiciary of lack of LFO at point of completion according to end dates within purchase contracts. (which courts and which region).
2) Those allowed to complete by Notaries without LFO/habitation licence in place (which Notary and which region).
3) Those exposed to major Town Hall delays re non-issuance of legal Habitation licences (which Town Halls and which region).
4) Those Town Halls that have issued illegal licences not built according to the project that was approved. (by Town Hall and region).
5) Those exposed to lack of time constraints on courts/judges who have subsequently suffered major delays and compromised clients ability to gain justice/ return of their monies within a 5 year time period (to include both developer and Bank lawsuits where applicable), thus compromising their right to timely justice? (which courts-1st instance and appeal courts, and which region).
6) Identify inequalities of time constraints within the justice system that are contrary to the rule of law in their one-sided favour to the detriment of clients.
- How else are ongoing injustices due to compromising delays going to be resolved if they are not consistently reported by those legally representing them? How else can these uncomfortable realities be effectively monitored to identify where thorough investigations should be targeted if they are not adequately and credibly reported by those legally representing clients?
