Hello All,

Is there anybody who attended the meeting in Newcastle that can update me on how the meeting went? I'm interested to know if any lawyer is being considered in representing those who are looking to act on our behalf to claim for a return of our deposit's and any other payments made to the builders at this stage?

I welcome any contact from those who attended the meeting or are aware of any others proceeding being considered (with the exception of using Lexland) I'm keen to speak with Carole or Bernard, but so far not had much luck.

I look forward to any assistance offered.

I received the following email from Lexland on 24 March.

It seems no monies have yet changed hands after over 4 months.
So much for completing things in 8 weeks max.

Thank you for your email.  Please be advised that due to the insurance company not replying within the allotted timescale we have had no option but to start jurisdictional procedures against them.

We are hoping to receive a positive reply shortly. No monies have yet been received.

I have been advised by Lexland that procurador will be attending the courts on Friday to get an update of the situation and I will let you know the outcome as soon as we have spoken to him.

Iam also going to visit the site hopefully if Lene from FV confirms week of April 13th.  I will advise progress.

Regarding progress http://www.valleromano.es/#/properties/monitoring.aspx  this website is certainly new to me and shows progress further advanced than the photgraphs uploaded last week; so if anyone is going out an actual report on progress would be appreciated

I have not got any update as yet I will chase them today and advise how I get on.

I contacted Lexland again about bank guarantee progress in the Spanish courts and received the following email response below.
Still no monies have yet changed hands after over 6 months but apparently things are imminent.

Any comments ?

If 8 weeks = 6 months and 3-5 weeks = another 2 months then I guess imminent = another month!

As we are rapidley approaching September is it not worth waiting until then so we can get compensation on top as well?

Regarding the claim against Grupo Vitalicio Seguros we have good news in relation to the first cases we have filed against Grupo Vitalicio Seguros and we have now Court resolutions in our favour issued by the Court of Barcelona nº 13 along with a ruling order forcing the insurance company to pay plus legal interest plus legal costs of the proceedings. The judge has also instructed the embargo of Grupo Vitalicio Seguros account in order to ensure the payment.

Therefore if you would now like to proceed with this matter please let me know and I will send you the relevant documentation.

Hi All,

Mike do you know how long it takes for Lexland to get any money back and are the up front fees still the same (I understand this is redeemable at the end)?

My lawyer is now saying that I can't activate my bank guarantee untill next year due to a grace period in the contract. He originally told me that I could do it in September this year.

Has anyone else heard this?

Jill did you get any feed back from your legal team?

It all seems to be getting very conflicting and confusing. Please HELP!

I was sure the test cases from Lexland were on the basis that work did not comence on the start date and not the completion date as you are right if you use this based on the completion date I am sure you have to give the 6 months grace period.  I am going to call my Lawyer this week as I have some questions and I will be sure to let you know the outcome.

I was under the impression you have to agree to the extension of 6 months, its not just available to the developer.

I may be wrong though, it has been known! 

I am a buyer at Valle Romano and I have been following the discussion until today’s date. I must admit that after reading all the comments posted here I did not get a clear picture of the situation at Valle Romano so I decided to visit the site myself.

After having done so I am much more comfortable with my investment. The building works are well ahead and the developer was very helpful. When I mentioned that I did not have much information on the project they advised me to enter their new web page of VALLE ROMANO and apart from that they send newsletters to all their clients about the project. My problem was that Valle Romano did not have my updated contact details, which seemed to be a common problems amongst many English clients, who have bought at Valle Romano.

They recommended me to enter valle romanos web page and send all my personal contact details via their contact e-mail.

I will be in the Estepona area from tomorrow to the 15th June; i've been trying to make contact with VR to arrange a visit to site, but so far no one has had the courtesy to respond; I even tried the contact details through the new website and also through my solicitor.

I am determined to visit the site when over and i will update my thoughts on progress with some pictures on my return.
