My lawyer got a reply from the developer today saying that no one is due a refund yet or BG has he hasn't broken any contract.

Hi Millwall
Not quite sure what it means but we got an email from the lawyer we were put with when we went in for apt at Valle Ramano, saying something about BG and monies returned,and there were three attatchments,which i cant get off,they were asking for 2,900 euros to start and this is the bit we dont understand,start what,we have sent it to our solicitor in Spain and she will explain everything to us,i may not be the brightest person but why would i pay thier lawyer that money to try and get our money back if need be ,when he works for them,
When i find out what it means i will be back in touch.

Sorry I spoke to Kate (F/V - hi Kate) and unfortunatly no free holiday for us. I think the problem is that they have no accomodation to put us in if they were to agree to it. Ha Ha.
Sorry I didnt really understand your last comment on here but I am sure we all agree it sounds dodgy. Spain, corruption, dodgy, scandal its all starting to sound a bit British. I bought my piece of mud to get away from it all, oh well never mind.
On a serious note there has been to much publicity for them to rip us all off. Talk Sport radio (Guanty never responded to my e-mails when all this kicked off), football clubs and everybody elase who has endorsed this need to save face. They have too much to lose. I am sure that if the sh** really hit the fan everybody would club together to get there money back somehow.
But for now I will listen to the calming voice from kate saying its all o.k.

Make sure you pay no money up front as the fees come at the end of a successfull claim, if any.

Their solicitor has just asked us to pay 2.900 euro on our credit card for him to represent us,we havent paid it we have our own solicitor working on it.

Hi all, i bought in Valle Romano development over a year ago, my solicitors areLexland. It looks to me that there is some confusion with regards to their last emails. I received one last week and they were letting us know that due to the development having started late that there is now an option to execute the insurance policies (bank guarantees) at this stage rather than waiting for the delayed completion.
I have completed the documents and paid the fees and am proceeding with the cancellation of my purchase without any problems and im fully confident that i will be refunded shortly.

You Must have the same solicitors as us is it Dimas and do you think we should go with them and pay the fees upfront,we have already paid our solicitor to start procedings but i was confused as i thought Lexland was working for Valle Romano .I couldnt fully understand the emails but did they mean that they would work on getting our money back.

Hi Carol,
Yes, Dimas Cuesta is my lawyer. Lexland does not work for Valle Romano. If you used them for the purchase i would say it might be a good idea to give them a call and keep your dealings with them as they have already taken care of your matters you so far. The email they sent was letting us know that they can start the ball rolling to get our money back if we did not want to wait any longer. Im sure if your other lawyer has not really completed the works for getting your money back you should be able to cancel them taking care of it and ask them to refund you.

Can you tell me how much the fees are that you have paid up front and what time span Lexland have put on the refund?

Hi Millwall,
I believe that the fees are calculated depending on the price you paid for your property. They ask for part now which in my case was under €3.000 and the rest on succesfull refund of the total amounts. Hope this helps.

I will check the fees out with my lawyer in the morning because when he got me my BG back on a development 4 years ago there was no fees.
Maybe things have changed now.

Are you with Lexland ? or have you got an independant lawyer, when we purchased it was through Lexland,but we also have our own lawyer checking things out, would you think it would make any difference which lawyer we used.

Hi Carol
Personally I think its always better to go with an independent lawyer rather than the firm that is working closely with the developer for obvious reasons. Your estate agent when buying should have told you that. It wont hurt to get independent advice at this stage and compare costs.

Thats what we thought anyway and we have had our own lawyer looking into it since July as she has always been very fair and not costly when representing us.
