Hi guys
I bought on Valle Romano over 3 years ago. I also had a call from the same lady , offering me a 15% reduction on my purchase
price. I have Lexlands doing all the legal work for me, in trying to get my money back at present, and they are sending me regular updates on how things are progressing.
It seems that they have had meetings with the general and financial directors of V/R, in order to come to some kind of agreement, with regards to clients who are in the process of cancelling their purchase at V/R
They expressed that after losing the ins co a considerable amount of cases they wish to avoid more lawsuits, and reach an agreement. Hence the phone calls from V/R
Lexland state that this is a reasonable request by V/R in order to start contemplating the possibility 0f an extra jurisdictional agreement, however V/R could just be after a simple delay in proceedings
If i hear any more i will let you know

I have also had this offer. I am also concerned that it is some way to delay the hearings for the execution of the guarantee. I am finding it extremely frustrating at how slow the courts appears to be in Spain. Even though my law suit was filed almost two months ago, the courts have still not even acknowledged that the have received it!
I am very concerned that this apparent offer from VR may cause the courts to put any decision on hold, even though apparently each case is being dealt with individually.

I am not worried about the offer delaying the case as this has nothing to do with the courts and the law suit. What we are doing is claiming from the insurance company for not paying out the policies, as far as i can see and what the lawyers have said.
How can an offer made by the developer who is not who we are fighting against in court have anything to do with a claim against and insurance company for non payment.
The offer has been made to us and unless we accept it and cancel the law suit with teh insurance company this will still go ahead. I know the courts are slow but as long as i get my money back i am prepared to wait even though i would prefer to get my money back sooner than later.

Our case was initiated in Oct 2009 and we have just been advised that the insurance company are challenging our claim. This has apparently happened before and they have always lost. Our court date is set for 25th May so when I find something out I'll let you know, perhaps it will put a few peoples minds at rest (or not) !!!!

I am not with Lexland I am using an independant lawyer. I spoke to him yesterday and he told me he will contact the insurance company in 2 weeks. Not sure why. Be good to see what happens on 25th, fingers crossed!

Wouldn't it be nice if someone who has actually had their money back to post on this forum.
i am beginning to think no one has had a refund despite being told that there had been some pay outs.

We have had the majority of our deposit now returned from Lexland. I am currently trying to open a Spanish bank account which is the only reason why the money is currently not sitting in our account.
It takes a while but Lexland have delivered what they said they would. We are just now waiting for our legal fees and interest to be returned.
Lexland are not the cheapest but they appear to be the only solicitors getting people's money back so it seems worth the fees.

I'm still at the 'lawsuit has been filed and waiting to hear back from the Courts' stage; how long do you estimate it took you from that stage? i started negotiations with Lexland in January but there seemed to be a great deal of time getting the Power of Attorney sorted and it wasnt until May that we got to the current stage. Am i right in believeing the courts close down for August, i'm sure i read that somewhere on this forum last year ?

We started the legal action the same kind of time as you - January. The difference is probably that we had already granted Lexland our Power of Attorney 2 years ago. I would imagine you probably only have a few more weeks/months before you hear anything. I think you are correct about the courts closing down in August - I think Lexland told us this last year before we started our action.
I cannot believe that the insurance company don't just pay up on 30 days rather than going to court and losing everytime. We had heard that VR Directors had been in to try and negotiate something to stop the action but nothing has materialised.
It's a real shame because we were so excited about this project and there's no doubt it will look very classy when finished. We just payed at the top end of the market and now our apartment would be worth half of what we payed. This is why we activated our Bank Guarantee.

My wife and myself moved into our apartment at Ville Borghese at the end of October 2009
we are very happy with the apartment. The Presidente Mrs Anabel Portela Gonzalez is most
helpful and takes care of any quiries that we may have.
The directors and there staff are most courteous and helpful.
The clubhouse is open for business with an excellent bar and restuarant with Paco,Francis,and Aristein
mor then willing to serve you.
It is a pity that so many people have pulled out,but I can understand the reasons why as this was to be an
investment,and nobody saw the credit crunch coming.
If you have the opportuinity to play the golf course I do not think you will be disappointed.
