Is there anybody out there who has seen a copy of a resolution from the Town Hall in response to the application for LFO by administrative silence - for any block/Manzana?  If so, how did you obtain a copy?

Further to deep investigation with other owners on La Reserva these past few months I can find no evidence whatsoever that any licence has been revoked on La Reserva.  The only evidence I could find indicates quite the opposite.  

All Mazanas and Bloques have applied (and been granted) for licences in line with the legal requirements of Spanish law, so how and why would they be revoked and what evidence do you have to support these wild and dangerous claims?

I have recently completed and have found no problems whatsoever with the process of completion or the paperwork required to do so.  I do however, have an issue with a lot of the negative postings on this site from people who are intent on attempting to ruin the reputation of the development and anyone remotely connected with it´s existence.  Why?  Because, I have an investment there and I want to protect my investment and nurture it´s growth as with any other.  The utterly slanderous lies that are being posted re licences etc on this site are damaging to the point of litigation and give the development an undeserved bad reputation which may in turn affect property prices and thus my (our) investment(s).

The only people who stand to gain from suing are the lawyers, no-one else.  The licences are in place and the banks are lending subject to status of the individual.  Sometimes, if the individual cannot prove to be in a financial position to be granted a mortgage, the bank will ´politely´ reject the application on other grounds (such as the valuation report etc).  There is nothing illegal with the way in which the licences have been granted for La Reserva - this is a fact.

I would love to hear from anyone who can prove to me in writing that the development is illegal.  Oh, and I´ll be grateful if you could post them on here for the benefit of all members instead of wasting my precious time by sending me hostile private messages which contain no evidence whatsoever.

We also completed recently and experienced no difficulty whatsoever in doing so.  We may also risk the likelihood of receiving some hostile messages from a minority of private messagers but we have had nothing but help and support from Penarroya, Jacobo Olmedo Garcia - our lawyer at ME and the bank that we applied to for our mortgage.  If anyone would like me to share information on how to complete please contact me.  Also, thank you to all who have contacted us by PMsg sharing support and optimism for the development - there are many of you that should post messages on EOS sharing your happy experiences of your time on the development!  From our experience the problems that are written on this site regarding licenses and the development either don´t exist or are magnified out of all proportion.

As I have said several times already, there are currently no Occupation Licences being issued to ANY development in Marbella because of the situation with the Town Hall and the council.  However, this does NOT mean that the development is illegal.  NOR does it mean that any licence has been revoked.  NOR does it mean that an Occupation Licence will not be issued. 

Moreover, all the paperwork that has already been 100% legally processed in order to apply for such a licence has indeed been delivered and received through ALL the correct legal channels and is currently in the system with the dozens of other developments in the same situation.  (I have seen with my own eyes a large file of paperwork with dates that  prove and support this and can arrange for you PERSONALLY to see, with your own eyes, and hold with your own hands, what I have seen, if it will help you move on from the gossip and come to terms with the truth of the matter). 

Therefore, to any mind with a fraction of commonsense, when the council situation is resolved in April / May 2007 (a mere 5 - 6 months away) the likelihood is that the Occupation Licence which is currently impossible to be issued BY LAW, can then and will be granted.

Hi

Have read with interest the postings and if you really do want to see situations regarding blowing situations of L.F.Os etc I suggest anyone looks at the other forum

If you have bought or have bought on the Costa del Sol and in particular Marbella then you may as well kiss your money goodbye by all accounts.

It appears that a few on that forum dont even own property in Spain but appear to be on a mission to destroy the market.

At least this forum allows a fair and balanced view

Hi Sunbelt, welcome to the forum.  I agree that some members of forums have their own hidden agendas and that they post rumour and gossip to induce panic and stress amongst people who rely on such sites for accurate information regarding their investment. 

Fortunately, this site is supported by members who know the real situation, recognise that their money is safe and who enjoy their apartments and the development when they complete.

I have had two neighbours in my bloque complete this month, very nice people they are too.  The gardens are very well maintained and if the weather holds up the way it is, I hope to be enjoying my first swim in the pool here before the end of February.

Hi Kenny

I am so glad I found this forum so as to get a balance view from friendly people.

If you say anything positive on the other forum you just get call a shark .an estate agent ,get told your are talking c---p,?a liar amongst many other things

I think the forum is controlled by two frustrated house wifes called Cl--re and  Ch---rlie,very rude and insulting behavour and they dont even have an interest in Spain,only to spread doom and gloom.

After 3 weeks on that forum I have had almost cracked up with having the sad on,s

Seems far more like it should be on here .
