Hi
Regarding this Plusvalia Tax I have checked my final account from SOL and could not find any mention of it , the only thing I have found relating to the tax is in a mail
stating the the contract states that I will be responsible for paying this tax estimated at between €300.00 & €500.00 .
I have mailed my SOL to find out if I did pay it and how much did we pay , as soon as they reply will post what they say .
Slight change of sujeject did anyone manage to get hold of a garage fob that can be used from the car and if so could they please post where the got it from , as I am fed up getting out of the car to open the garage door .

Hi all and thankyou for your replies,and for those that I am still waiting for from Margo Robbie.
It would appear that the solicitor have been less than useless with regards to this matter.I cannot remember any correspondance from my solictor pointing this out on the contract.
I will have to see how this pans out ,but at the moment "deriliction of duty to client "springs to mind.
But not even that explains estimated cost 850 E actual cost 1900E something dodgy me thinks.
Watch this space.
Of course it would be easy to check at Manilva Town Hall if I could make myself understood,does anybody know if they speak english there.

I have been in contact with Chris olsen as suggested by Laurden,very informative,Nothing should have been paid at all.
The town hall in Manilva have not issued the statements yet,and apparently send them out sometimes two years after completion.
So that begs the question why are the solicitors charging and possibly overcharging for this.
The bottom line is that the developer should pay this tax by law. This has been confirmed by two independant solicitors.

Glad Chris could be of some help. We are very fortuanate that we have chosen an area like Manilva that offer help in the way of Chris.
Here is a little info on him that may be of interest
The Manilva Town Council have recently appointed local British resident, Chris Olsen to take on the role of liaison officer between the English speaking community and the Town Hall. Chris, a former physics teacher in the UK, first settled in Spain in 1969 when he lived in Marbella, before moving to Majorca in 1972 where he ran a local language school, as well as being the local secretary for Cambridge University. Chris became very active in the expat community becoming Majorca Lions Club’s youngest ever President. The local Lions Club was the most active in Spain at the time with a membership covering some 17 different nationalities. After a brief spell in France in the early ‘90s, Chris returned to Spain and settled in Manilva in 1996, and many of you will know him from the bookstall he runs on the Sunday market.
Chris’s interests are football, the environment and adult education, the latter of which he is keen to promote access to such schemes as the Open University and other distance learning projects. Chris has a BSc (hons) and a MSc in science and adult education and is currently finishing a thesis for submission to the OU.
Chris first came into contact with Antonia Muñoz within days of moving to Manilva. He had purchased a property in Punta Chullera and the day after he moved in a gang of workers turned up to erect a huge mobile telephone mast on an adjacent plot. After calling the local police, who halted the works, Chris thought that was the end of it, only to find the construction continued immediately the police had left. After this process was repeated 5 or 6 times, Chris went to the Town Hall where Antonia Muñoz was the Mayor at the time, and on hearing of their plight she issued a decree banning the mast, and solving the problem permanently. With this in mind, Chris decided to offer his assistance during the 2007 local election campaign, and it was decided that given his contacts amongst the expat community and his fluent Spanish, he would make an ideal candidate for the role of liaison officer. Chris will be working out of the Foreigners Department Villa Matilde, which is the building just in front of SuperSol on the Sabinillas to Manilva road.
Opening hours are Monday, Tuesday, Thursday and Friday between 8.15 and 9.15 am and 11 am to 1.30 pm or you can visit Chris at his bookstall at the Sunday Market from 9 am to 2 pm.

I received this from the solicitor's office today (not from the usual person) " Regarding your question about the Plusvalue tax, this is to inform you that the Council still has not served the receipts of this tax and they do not know the amount to be paid.
When it is a new building property like yours, the Council takes long to serve the bills. We are in touch with them and as soon as we receive it we will settle the Plusvalue tax." So I am even more confused, because my understanding was that we have settled with the solicitor and all that is finalised. Watch this space, I suppose.

Saw our solicitor yesterday,who confirmed that you definately should NOT be paying this tax as the Deveoloper had it in the original documents that he would be paying it,which aparently is quite unusual,as Developers usually try and push it onto buyers to pay. We were never asked to pay it and neither should anyone else.Good luck!

Thanks for the reply,things are not good with my solicitor,although they did email me last week,but evaded the questions I had put to them regarding this tax.
Good to see you are enjoying yourselves ,will keep informed of any progress regarding the P v tax.

Hi,
Have received a reply from Sol regarding Plus/Tax , they are stating that we have to pay this tax as it has been put into our contract by the developer.The Sol has sent a copy showing that we have to pay this tax, it seems there are different rules for different Sols.I have spoken to the Sol and he has informed that when the town hall set this tax we will have to pay it not the developer as it is set in the contract ,I will keep pushing him to see if he can get the developer to pay it as I believe it is illegal to make the buyer pay it , will keep the web in formed as to what happens.

That´s very strange as our solicitor told us the exact opposite ie that it was in the contract that the Developer would pay.She said that the only time we would have to pay it would be if we sell the property.She was most definate about it all and has been on the ball with everything else. Something is wrong somewhere....

I think it depends on the solicitor.,and if he gets any favours for making the buyer pay ie more work passed his way etc.
It is definately law that the developer pay this tax.I believe this to be a new law ,so when it was introduced I dont know,but all I can say at this moment Its" bloody dodgy".
I also think individualy we should have been informed that this is written into the contract ,"2nd page from back" but hey you pay a solicitor and I would expect them to have my sole interests foremost.
They can then challenge the contract ,which I believe some solicitors have successfully done.
I have emailed the Law society In Malaga and now waiting for a reply.Will post what they say but I am not holding my breath for a favourable answer.

PS dont let this little matter spoil your new apartments,even if I have to pay at the end of the day it wont detract from our lovely apartments and the joy they are giving us

Too right Robbie, I am so looking forward to going on Thursday. I shall probably bump into you in December as I am going back out there on the 29/12 for New Year
I was only thinking this morning that some of us have now had our new homes there a year come this Jan/Feb, I for one have not looked back and thoroughly enjoy owning and using the apartment. To anyone thinking of purchasing a holiday home in Spain, don't think, just do it, I have had a fantastic year and looking forward to many more to come!
