Thanks for your e mail and all your efforts to try and resolve some of the awful mess we are all involved in.
We have a few questions about the proposals:
The Site
The site is still very much unfinished in terms of communal areas and Murcia Council wont grant a Licence of First Occupation (LFO) until everything is done. Isn't there a danger that residents will be left to pick up the bill of finishing the site when it is the developer who should have done it.
Specifically: huge area of rough land infront of commercial area will need to be landscaped, all the electricity wires currently on telegraph poles will have to put put underground, road signs to be purchased and erected , tarmac finish to roads, drainage problems (Why are all the road drains blocked off?) etc.
This could come to thousands of pounds!
We also believe that the council require a new access road to the site to be built. We were all asked to pay €3000 each towards the cost of this. We were told that the council required this before the LFO would be granted. The road has not been built and what has happened to this money - is the developer going to build this road or will the money be passed back to the community? We haven't seen any plans for this road, but this could cost millions of Euros. Will the community take responsibility for this as well?
Water and Electricity
Looking at the experience of buyers on other developments, the utility companies will not connect individual properties without LFO. It is the builder who applies for this after they have finished the development to the standards required by the Council. This means the site has to be finished to match the original plans. There could be huge problems here as we don't know what the original plans are and it is a common belief on site that the builder didn't stick to the plans anyway.
How do you know that the utilitity companies will let our community take over Antonio's supply which is a 'builders supply' They supply these utilities at a builders lower rate for building purposes. If you are successful how will you administer bills to individuals with a common supply?
Those people that have completed have a clause in their notorised deeds to say that all utilities would be provided free of charge until LFO was granted and individual contracts with utilities were available. Looking at the recent history of the developer, how do we know that the €200 will be used to pay the utility bills? More likely this could be used for some 'other' purpose.
We think that Antonio knows it will be a long time (possibly years) before The Council will give the LFO's and that the cost of putting the site right may take thousands to complete. This might be why he is so happy to sign the site over to a community?
We are not trying to be negative but we are concerned about the future. There are many unanswered questions at the moment - this post is just our initial thoughts and I'm sure the other residents will have lots of other questions. Grupo Mediterranea might know all the answers to these questions, but we don't know that yet and we need to ensure that ALL the facts are known before a course of action is commenced.
