Hi everyone
First can I take this opportunity to thank all the people that turned up today it was much appreciated.
To summarise the meeting we elected a committee of 7 people details to follow shortly and now we will form the community in approximately 4-6 weeks and then we will be responsible along with Murcia Town hall for the up keep of our private urbanisation.
This responsibility will take the form of a community charge for the shared amenities on the urbanisation and i am sure that you are all wondering how much? At the moment we need to work with Pentagono (Grupo Mediterenia) to finalise this figure because we need to assess the services required and get the people to tender for the services. It was decided that everyone would pay an initial 100 euros to the community fund to start the community going full details of this will be supplied shortly with the full minutes of the meeting.
The other main question to arise was with regards to the 200 euros asked for this month by El Trampolin we would ask that everyone pays this amount this month to ensure the constant supply of electric and water to the whole community as you can appreciate the total bills for the utilty companies must be paid to keep supply and as their are many families living on site it is imperative that this is maintained. This will be the only bill to pay from the office as we as a community will be responsible for the upkeep and future bills from now on, but this money is to cover the historic bills of the company and ensure our continued supply.
Once the meeting had finished me and the Director of Pentagono went to the office for a meeting with Antonio and the meeting was very positive we left with all the necessary papers to finish the process of forming the community and we were told to return to the office should we require any further help which frankly neither of us expected.
So the outcome of everything was very positive and we will be working very hard next week to bring everything to a conclusion .

Thanks for your e mail and all your efforts to try and resolve some of the awful mess we are all involved in.

We have a few questions about the proposals:

The Site

The site is still very much unfinished in terms of communal areas and Murcia Council wont grant a Licence of First Occupation (LFO) until everything is done. Isn't there a danger that residents will be left to pick up the bill of finishing the site when it is the developer who should have done it.

Specifically: huge area of rough land infront of commercial area will need to be landscaped, all the electricity wires currently on telegraph poles will have to put put underground, road signs to be purchased and erected , tarmac finish to roads, drainage problems (Why are all the road drains blocked off?) etc.

This could come to thousands of pounds!

We also believe that the council require a new access road to the site to be built. We were all asked to pay €3000 each towards the cost of this. We were told that the council required this before the LFO would be granted. The road has not been built and what has happened to this money - is the developer going to build this road or will the money be passed back to the community?  We haven't seen any plans for this road, but this could cost millions of Euros. Will the community take responsibility for this as well?

Water and Electricity

Looking at the experience of buyers on other developments, the utility companies will not connect individual properties without LFO. It is the builder who applies for this after they have finished the development to the standards required by the Council. This means the site has to be finished to match the original plans. There could be huge problems here as we don't know what the original plans are and it is a common belief on site that the builder didn't stick to the plans anyway.

How do you know that the utilitity companies will let our community take over Antonio's supply which is a 'builders supply'  They supply these utilities at a builders lower rate for building purposes. If you are successful how will you administer bills to individuals with a common supply?

Those people that have completed have a clause in their notorised deeds to say that all utilities would be provided free of charge until LFO was granted and individual contracts with utilities were available. Looking at the recent history of the developer, how do we know that the €200 will be used to pay the utility bills? More likely this could be used for some 'other' purpose.

We think that Antonio knows it will be a long time (possibly years) before The Council will give the LFO's and that the cost of putting the site right may take thousands to complete. This might be why he is so happy to sign the site over to a community?

We are not trying to be negative but we are concerned about the future. There are many unanswered questions at the moment - this post is just our initial thoughts and I'm sure the other residents will have lots of other questions. Grupo Mediterranea might know all the answers to these questions, but we don't know that yet and we need to ensure that ALL the facts are known before a course of action is commenced.

With regards to the first question we will have formed by next week a limited company run by the committee and we will work in conjunction with Murcia council so they look after the roads street lights and we maintain all the communal areas the council will make the company finish the areas to a satisfactory standard and we are now recognised and we can push the council to implement this.

The huge area in front of the commercial is land that has been given back to the council when an urbanisation is made a percentage of the land has to be given back to the council so we must negociate with them

The money has been deposited with the council and yes the road hasn’t been started but if you see the over all plan for the area you will see why the project for the new roads is massive I have an appointment at the Town Hall on Tuesday and I will try to get the proposed plan but the whole bill for that will 154 million  the  is a plan in the Laverdad 29 Aug 2008 page 5 it shows our new road so the council wont return this money and they decide when they start the project.
The electric we know that they won’t allow us individual supplies but what the company has done is set up an entity and this means the community is a Spanish limited company the same as the builder and with this they will allow us to take over the supply.
This question of the aged debt being paid has cropped up a lot and the Administration Company advises that we all pay the 200 euros this will show the utility companies that we have all paid for the continued supply of utilities and acted in good faith also showing that as a whole community we want to pay if only 60 – 70 % pay they will see that it could be a struggle to get the money off the 30-40 % and decide they don’t want to transfer supply which would be devastating for all of us especially the people who live here.
Antonio signing the community to us does not mean he isn’t responsible for finishing the site and redress is from the council not us.
To close the course of action is commenced already we have formed a committee and we will take over the S.L company next week this is the only course of action because if we hadn’t have done this control would have reverted back to the company.

THIS IS THE FIRST TIME i HAVE DECIDED TO EMAIL RELATING TO TRAMPOLIN.  UNLIKE MANY OTHERS THREE YEARS AGO WE PURCHASED PAYING 70% OF OUR PROPERTY.  AT THE TIME HAVING NO IDEA THAT PLANNING HAD NOT BEEN GRANTED. 

NEVERTHELESS OVER THE PAST 2 YEARS WE HAVE ALWAYS PAID WHAT HAS BEEN ASKED FOR FROM TRAMPOLIN.  SO NOW WE HAVE PAID A FURTHER 14000EUROS.

THE RECENT EPISODE IS THAT WE WERE OVER  TO HAND POWER OF ATTORNEY TO OUR LAWYER TO COMPLETE  AND WE PAID THE 200EUROS WHICH WAS REQUESTED.  THEN TRAMPOLIN DISCONNECTED US AND INFORMED CERTAIN PERSONS WE HAD LIED ABOUT THE ARRANGEMENTS MADE. ( WE WENT AGAINST OUR LAWYERS ADVICE NOT PAY AND ONCE AGAIN HE WAS RIGHT.)

Some of you may be aware that the Commercial Units had their electricity cut off earlier this week.

The Commercial Units had their electricity reconnected yesterday and Happy Days opened last night.  Claude went down to the office this morning and was told by Antonio that he no longer wanted Claude & Millie to run the bar and asked them to close the bar and move themselves out.  Claude & Millie are going to open Happy Days at 7:00 tonight in order to explain to their customers what has happened and also to say goodbye to everybody.

Hi Jogary, yes the madness continues and no I cannot offer an explanation apart from saying that this afternoon all the furniture from the bar was being loaded into 2 vans and being taken away.  The Bar extension that was being planned into the "old" supermarket, where an archway was built last week, has been boarded up again today.

The Launderette business has been closed and transferred back into the Valle;  the Curtain and Bedding shop has been closed.  As far as I am aware, the Printers and Hairdressers are still open

We are very concerned about what is happening on site.

Love the pigs though! Maybe one day we might see them over Trampolin!

Just read the latest post on the 'Lo Santiago' forum. A post made yesterday says the commercial centre shops are back to normal. But if the restaurant has been closed and tenants evicted, how can thsi be? Have Millie nad Claude been reinstated?

If bins have gone, we should take our rubbish and leave it at the office.

Do any of the new committee members have any news on how thier meetings went this week with the utility companies?

Any news would be much appreciated.

Cant help you with regard to the damp question but maybe someone else might post as I know others have the same problem.

We do have the internal and external cracks though. We completed 2 months ago but have given up trying to get defects sorted.

Personally, I think you have more chance to get work done before you pay the final instalment but if the company has no money (like they say) it will be hard!

Why dont you contact the committee member for your phase? They should be able to tell you about similar defects others might be suffering.

I think an earlier post said that Millie and Claude had been asked to leave! Now we have no facilities at all.

We had another meeting on Friday 5th Dec. Antonio has demanded another 200e and once again threatening to cut off electric and water, the bins have been removed and we have no street lighting! People are deciding individually if they are going to pay or not but run the risk of being without utilities over xmas and new year! So once again we are being illegally black mailed! Denuncias are being placed individually and the more the better!!

The update from Saturday’s meeting is as follows
Solera El Trampolin are demanding the payment of €200 for the supply of the electric water sewerage security street light and rubbish collection and have advised everyone in a letter that further legal action will be taken if people don’t pay saying and I quote from the letter dated 2/12/08 “please be aware this could lead to an embargo of your property”  let me reassure everyone this is impossible as the community in which the company is claiming has not yet been formed and as such all these demands are illegal.
As for payment we advised everyone in November to pay but this month the decision is up to the individual people living here are in an impossible position as Christmas is around the corner and we all need electric and water so most will be forced to pay under protest, but the upshot is simple people who pay have water and electric the ones that don’t have the risk of being cut off.
The status at the moment with community is the “entity” will be formed on Thursday in the town hall and Jose Ramon from Grupo Med is in contact with the town hall and once that is finished he will start the process of signing the “entity” to us we are not sure how long this will take as we have the Christmas break, once this is done we can then make the application for water and electric supplies. So the process has been started but we have no control as to the speed that this will be done but be reassured Grupo Med are pushing hard as they don’t start getting paid until the community is formed.
Also we still need as many people e-mail addresses  as this is the easiest and quickest way of communicating with everyone so please forward your e-mails ASAP, if you don’t have e-mail please pass on other contact details so we can contact everyone

Good news just recieved from the admin company for the urbanisation their is a meeting at NEW YORKS (old happy days) on Monday 22 dec at 10.00 for the community to be signed over to us so could everyone please attend this is very important

Good to hear some positive action is occurring.

When you mention 'New Yorks (old happy days)', do you mean that Happy Days has re-opened under a different name/management? Is it still a bar/restaurant and is it owned by that wonderful Antonio fella?

Thanks for your vote of confidence please post with yur name and i will personally take thiss issue up with you my personal phone bill for me last month was €290 euros keeping people informed i have asked everyone for their e-mail addresses and i post on eye on spain and for so if you feel you can do a better job of keeping people informed please feel free to step up to the job
