Don't know if it's just my reception but has anybody else with Sky TV noticed that the MRI channel, Overseas Property TV is just coming up with a black screen?

Have they shut it down or what?

Interesting article Mazbaz, something appears to be going on, why the secrecy? I was going to use MRI's management team to rent out an apartment in Bulgaria, but they contacted me a couple of weeks ago to say that they did not have the staff and was transferring me to someone else, coincidence?

I am not surprised with MRI. Just surprised it didn't happen sooner. Based on my experiences, I am glad I got out of this company's clutches some time ago - but sorry that others may have not. Undoubtedly, they will just rebrand and then carry on doing the same thing. Is secrecy to do with the issue of paying creditors?

BTW, I did notice some time ago that many of the MRI regular presenters were working for British Forces Broadcasting Services. The latest news just confirms what I have suspected for some time.

Well folks it is a sad day here at the rumour mill. No, the overseas property industry has not cleaned itself up over night (far from it!) If you are a regular reader of this blog, you will know exactly who we are talking about. Apologies to new readers who are not aware of the previous posts which are no longer on public view.

It would seem several perfectly innocent people are, have been, (and no doubt would be) threatened with lawsuits by a certain company. We have been contacted through the comments section on the blog by a number of entities about our recent publication of certain articles about certain companies. We are not publishing these comments at the request of the writers, but they do make some interesting reading as to the legal veracity of them. We have also received a number of comments from both the industry and the public praising what we had written, even from another former company owner about which we had commented.

In a nutshell, all and sundry that appear to have any connection to the rumour mill, or any of the pseudonyms we use for posting have been bombarded with legal threats from the said certain companies in question. It would seem we have touched a few nerves here and there by all accounts, and in the never changing habits of a life time, the companies in question have seen fit to threaten everyone and accuse them outright of slander when in fact they have no connection to us whatsoever.

We at the Rumour Mill still stand steadfastly by what we have published. We have removed the posts to protect the innocent from general aggravation and grief from the companies we have written about. This post is not a retraction of statements, nor is it any kind of admission of wrong doing, slanderous behaviour, or anything else come to that. All comments and postings made by us were factual, with concrete proof of what was going on, as everyone saw. The sad situation is that as always, if you have enough money you can buy good news.

The fact that we did republish an article released by the said company, promoting them and in fact praising them on an eventual press release about their activities (which outranked them in the search engines and therefore was promoting them) seems to count for nothing. Needless to say we have removed that article too.

The various mediums we use for promoting the blog have been updated, some will take a few days to update, but sadly the articles are having to be committed to the hidden pile for the time being.

There were about 10 other reports. I also believe that MRI removed themselves from the National Association of Estate Agents last year after complaints were made against it by many clients and former clients. The NAEA were in the process of investigating the complaints at the time. For those intereste, the full text of their findings:

The Determination by the Disciplinary Sub-Committee of Case No. 52346

The Determination is dated: 2 September 2008

The Respondent:             The Complainants:

The Hearing

1.1   The NFOPP Disciplinary Sub-Committee sitting as a Tribunal met at Arbon House on Wednesday 20 August 2008.

1.2   The Tribunal was chaired by Mr J F Atkins assisted by Mr I Lumbard and Mr M Hayward.

1.3   In attendance were Mr M D K Jones, the Business Practices Officer, Mr D Oliver, the Compliance Officer and Mr P Bolton King, the Federation’s Chief Executive.

1.4   The Complainant was in attendance at the hearing.

2.     The Business Practices Officer alleged the following, breaches:

Rule 2(2) No member shall do any act (whether in the business of estate agency or otherwise) which:
-     (h) involves unprofessional practice or practice that is unfair to members of the public.

Rule 2(3) A member who is a principal shall be responsible for the proper supervision of his partners, fellow directors and staff in the conduct of his business and shall be liable under these Rules of Conduct for any breaches as if such breaches had been committed by him.

Rule 6 Duty to abide by the aims and rules of the Association.

Rule 7(1) A member shall not seek business by methods which arc oppressive or involve dishonesty, deceit, or misrepresentation. Members shall not use any business term, name or initials which could cause contusion between their own business term, name or initials which could cause confusion between their own business and that of the Association. In pat Ocular, the word ‘HomeLink’ or the initials `NASA’ may only be used in their correct context with reference to the Association.

Rule 12 Duty to applicants and others.

The Federation’s Chief Executive entered a plea of not guilty on behalf of the Respondent.

The Tribunal’s Decision

After hearing the evidence and after deliberation the Tribunal’s findings were:

Rule 2(2)(b) - Proven
Rule 2(3) - Proven
Rule 6 - Proven
Rule 7(1) - Proven
Rule 12 Proven

The Business Practices Officer advised that the member had no previous disciplinary record prior to the date of the hearing.

The Federation’s Chief Executive advised that no plea in mitigation had been received from the member, however; he did refer the Tribunal to previous correspondence received from the member and his legal representatives.

Penalties

Rule 2(2)(b) - £1000
Rule 2(3) - £1000
Rule 6 - £1000
Rule 7(1) - £1000
Rule 12 - £1000
Costs - £163

The Tribunal made the following statement:

“We have today heard a number of complaints concerning the practices arid service of MRI International (the Company). Mr D MacAnthony is Chairman of the Company and he was a member of the National Association of Estate Agents (NAEA) when the relevant breaches occurred. Rule 2(3) of the NAEA’s Rules of Conduct confirms that members are responsible for the conduct of their staff.

A number of the complainants attended the hearings to represent their cases and were questioned by the Disciplinary Sub-Committee (the Tribunal). The Tribunal were disappointed that despite a previous adjournment of the hearings at Mr MacAnthony’s request, neither Mr MacAnthony, nor a representative from the Company, nor a legal representative of the Company, were present at the hearings.

The Tribunal were appalled to hear of the Company’s misleading business practices, including unfulfilled promises of guaranteed rental returns and misleading descriptions of the facilities that would be available to owners. The Company accepted deposits for unbuilt and unidentified properties. In some cases a purchase price was not included in the documentation provided to buyers. These problems were compounded by the Company’s poor service, including their reluctance to resolve grievances after sales had been agreed.

Despite these omissions, the Company’s position is that there is no right of cancellation by buyers, and therefore their deposits have not been returned to them. As a result members of the public have lost considerable sums of money resulting from false and enticing statements made by the Company.

In all of the cases considered by the Tribunal the complainants were represented by Legal Independence/Martin Echevarria, who were recommended by the Company. Although the Tribunal’s considerations related to the Company and not the professional conduct of Legal Independence/Martin Echevarria, the Tribunal cannot emphasize too strongly the particular importance of independent legal advice when purchasers are considering purchasing overseas properties. The Tribunal is currently considering whether to take this matter further with the Law Societies /Bar Associations in the relevant countries

The complaints heard today were a sample of many more complaints received by the NAEA about the Company.

The irresponsible practices brought to light by these cases risk damaging consumer confidence and the reputation of estate agents working in the UK and overseas. The NAEA expects the highest standards of practice and ethics from its members. The level of the fines imposed reflect the seriousness with which the Tribunal views the behaviour of the Company, and therefore of Mr MacAnthony.

The NAEA has received a resignation of membership from the Company. As membership is individual and personal, the Tribunal understands the NAEA has presumed that Mr D MacAnthony has resigned. The Tribunal welcomes this development as they would have had no hesitation in terminating his membership in addition to the financial penalties imposed.”

Recieived an e-mail from MRI aftersales today stating that as they no longer have an office in the Costa Blanca area or anybody around there to help me get my NIE number when I visit in February. I have of course asked for the return of my Lifetime Aftersales membership fee because in my eyes they have failed on their side of the agreement.

Without prejudice.

Good legal term that, it means you are not exactly accusing anybody of anything!

That's very interesting reading Ash.

We're in the process now of changing solicitor from Echeverria's to a different one. It's going to mean an additional cost but it will give us peace of mind.

Hi all

I feel many of us have not been happy with our legal representation, this was certainly the situation with me, as a result I  asked Lisa Mona to reccommend a lawyer to me which she kindly did. The lawyer is English ( very prompt at replying to emails) , the company has an office in Southern Spain, and certainly appears competent and independent. It may help our cause if at the end we need some leverage,  for as many of us as possible to be represented by the same lawyers and it may well reduce costs, if anyone is interested in this lawyer please pm me for details ( I'm sure Lisa would not mind either).

Dear All,

1) A quick update on MRI.

A new company has recently been established by the name of 'DCC International Property Limited' and it has the same Spanish address as MRI. Two of the directors are Mr Michael LIGGAN born in Madrid (Spain) on 15 February 1977 and Mrs Wendy MACANTHONY born in Dublin (Ireland) on 21 September 1980. This company is part of the DCC Group S.A. registered in Luxembourg (http://www.etat.lu/memorial/memorial/2008/C/Pdf/c285427B.pdf - scroll down to the section on DCC and information is available in German and English).

Michael Liggan was Chief Executive of MRI and Wendy MacAnthony is believed to be a close relative of MRI's Darragh MacAnthony.

Many of the properties they are marketing are similar to MRI's. I am not sure if this is a different company or the same one being rebranded.

2) I for one will be changing to the independent solicitor recommended by Lisa. Based on personal feedback, I am sure others are considering the same.

I hate wasting my time flogging dead horses, but thought it important to close the loop regarding MRI:

The National Federation of Property Professionals (NFOPP) has rejected appeals made on behalf of Darragh MacAnthony by Dominic Pickering, the new CEO of MRI Overseas Property, against its malpractice judgement last year.

The chairman of the Disciplinary Appeals Committee, I.F. Rose, FNAEA (Hon’d.), said that the Appeals Tribunal had given the utmost thought and deliberation to a host of information but had decided to reject to the appeal and that the findings of the original Tribunal remain in place.
