Hello All
I guess most people who bought a property for phase 1 block 7 are now in your apartments . Some of you maybe wondering why there is no one in 1st phase Block 7 number/Entrance 22, 1st Floor, B. and why the parking space of 195 and Storage room 88 are all empty. Let me shed some light for you.
Well after nearly 6 years of trying to complete on many occasions and then it falling through for various reasons of mortage companies,lawyers not ready, licenses not signed etc...you know all the excuses Im still yet to complete.
The latest reason over 6 months ago was building license not being completed and that was Lloyds excuse along with the owners to pull the mortage offer until the bank agreed this was done.
My lawyer(Anderson) are still trying to fix this but to date not really hearing anything back.
I would ask a favour to the people who are in this block if they could kindly just have a look at my apartment and let me know if it is stood empty. I would hat eto think someone is living in this especially as teh developer has £50,000 of my money for 6 years.

There are a number of empty apartments in Block 7 so I doubt you have anyone in there. Ken & Lyn are out at the moment so they may be able to have a quick look. Hope you complete soon.

Hi Mike,
There appears to be no valid reason why you can't complete if you want to. When we completed in May, both our lawyer and mortgage provider were happy with everything. We bought the apartment as a long term investment and possibly our home in the future and we are very happy with it so far. There are still a few problems surrounding this development but we have not seen anything else in the area at a similar price that we would rather own.

The issue was with Lloyds who would not relaease mortage until full license was signed at teh notary , its a small technical point but they would not realse funds until this was done by the owners i.e the bank
As a matter of interest who do you use for your mortage and lawyer

Our mortgage is with Banco de Andalucia, who provided the builders mortgage. The application and paperwork was simple and straightforward and the branch staff in the Puerto Duquesa branch are wonderful. We originally banked with Halifax, as we could transfer money from the UK without charge, but their exchange rates were rubbish. After dealing with Banco de Andalucia for the mortgage, we decided to use them for all our Spanish banking and use Moneycorp for the monthly mortgage payments from the UK. Our solicitors are Martinez Echevarria in Marbella who were recommended to us by Viva Estates when we first started the buying process in 2003. We now realise that this is regarded as a big mistake to use a lawyer linked to the agent but we have no complaints with them other than the slow pace !!

our lawyer was the same recommended by mri. turned out they are linked to them also. however, i was very pleased with how the did things. our bank is with sol bank. beware they charge you for walking in the door!! i suppose they are all different

Our solicitor is Lex Marbella, recommended by Viva Estates and they have been very helpful. Our mortgage is with UCI an affiliate of Santander. This was obtained through Green Independent, a broker just the other side of Marbella who again have been very helpful. Our bank account with Santander is relatively charge free although we originally had one with Barclays which was expensive.

We completed and moved in to Block 7 Portal 22 Apt 3A last Novmber. We are out here at the moment and can confirm that we haven´t seen any activity in your apartment or indeed anywhere else in our portal. Ken and Lyn are in portal 23 on the top floor and there is a couple living under them. We don´t understand why you haven´t completed as there were no problems for us.
Even though the road is at a standstill there is plenty of activity everywhere else on the various Prienisur sites.

This issue lay with Lloyds as they wanted a license signed, other banks were happy to complete without thi sbut Lloyds are very anal. SInce this (6 months ago) I have asked my layer to discuss some sort of compensation as I was due to complete in Agust and for one reason or another the bank kept cancelling (thats them) not mine.
Waiting to hear back form my lawyer

We have just checked our licence and it is the same as the one shown on forum , it states that the licence has been granted for a total of 152 apartments which is the total number in blocks 4,5,6,7,11.&12 . It may be worth while mailing a copy to your bank and lawyer to see what they say, as it is there in writing that the licence has been granted and I see no reason why they will not let you complete .

Guys I just wanted to clarify; it is not the license that is the problem, that was available early on, the thing that is causing the whole problem is the certificate Acta Final de Obras, which is basically a certificate confirming that the work has finished on the property. Once issued this then needs to be registered at the notary which will in turn show on a new nota simple as a finished property. The nota simple at the moment shows the property as still being in construction i.e. not finished! My lawyer informed me that the developer ‘forgot’ to get it registered and I guess this is still ongoing – unbelievable!

Met your neighbours in Apt A (opposite your front door) very briefly when they arrived on Monday-they are Malcome and Carol-seemed ok. Didn´´t get time for a chat much though as we had friends with us and were on our way out.Will let you know if I found anything out.

You folks over there are not alone as exactly the same thing is holding up the next lot of completions over here on Arenal Golf Benalmadena. Occupation licences have been issued, but the building work has not been certified as finished and subsequently registered.

With regard to your apartment not having the (Acta Final de Obra ) I contacted my SoL to check if our apartment had this licence, the reply they sent back states that the Licenc of First Occupation cannot be granted unless the Acta Final de Obra has been granted. So once again we are getting conflicting stories because we know the FLO has been granted as we have a copy , therefore it should follow that the (A Fde Obra) should have been granted,

Hi Mike we have just returned and I can confirm no one is in your apartment.I think the trouble could lie with your solicitor,Andersons office is like the mary celeste no body around ,lights off etc.They have appointed a office admin guy especially to tidy up the mess they are in.I am in dispute with Andersons and have met this Guy on two occasions and really seems to be making headway in my favour,will let you know the outcome soon.
