I know  that such short notice is a pain in the preverbial but its not just Polaris that opperates this way.

So please do not think that this is an isolated case by one company it isnt.

But like you we too would have liked to attend but having only just returned home after a 2 week stay it will be impossible to get the time off

Hi all,

My name is Andy and I represent CDA Services, specializing in services to residents in Condado de Alhama.

Although we work at supplying furniture packs and garden furniture, having seen this thread, I am considering offering my availability to attend the general meeting and take votes for residents who cannot attend.

I have experience in such meetings as I have lived in Spain for many years and have been the president of a community in the Port of Mazarron before.

I speak Spanish and know the ins and outs of the community systems.

Having seen the thread, I am considering attending on behalf of residents and voting on their behalf.

As a services company offering services to Condado de Alhama I would be able to help the residents.

I am not asking for payment for this service as I also am a resident of Condado de Alhama and it would be an extra service to provide to fellow residents.

However I am only considering this at the moment because I know from experience the amount of work and commitment involved in representing fellow residents.

If you would like me to represent you at the general meeting, please PM me with your details.

I must stress at the moment that I am only considering this at the moment because I know the work involved in this and the commitment it takes.

Once again, I am not asking for payment and for this reason also, I may decide against it because at the end of the day, I have to work and make a living!

I will decide by the end of the week, but in the meantime by all means, PM me if you wish.

Hi Cuz

You don´t know what you will be voting for because the votes are not raised until at the meeting and are then voted on at the meeting.

You can have representation by a fellow resident who has the same interests in the Resort as you, or you can simply not vote!

Cuz I believe we will be voting for a president to represent our mini community, if one is not voted then PW will stand for that indivdual community, I am hoping that a full time resident may step forward and represent us.

You will not vote on anything that is not on the published agenda, Spanish Law dictates this.

You will probably find that all this initial meeting will do is

1) Adopt the statutes & rules for the development

2) Agree the budgets

3) Appoint the President & Vice President

I like the idea of a block vote from here of people who can't attend.  I was actually coming on here to suggest that when I saw the post from Andy (CDA).  If you are up for attending on behalf of all of us stuck in the snow in the UK I'm more than happy to transfer my vote to you also.

We also had this notice today. We don't know what to do with it as we are not out at the time of meeting and do not know anyone in Los naranjos Jardin 2 as yet. Can anyone advice?

If you have not completed as at the date of the first community meeting, you won't receive an invitation to attend & you will not have a vote.

Once a certain proportion of completions have taken place, the developer will take the decision as to when to hand over to the community.

On another thread here, it is stated that PW are going to back date the community fees. I don't think they can do that & would advise someone to contact Maria de Castro (Spanish Solicitor) on the main forum of EOS to ask that question.

We have not yet received an e-mail about the meeting, and as we have owned our property since July would have thought we would have been contacted. Can anyone give me the details of who to contact re the meeting e-mail etc....

Hi All

As I stated in my earlier post, I responded to the email notification of the first community meeting by using the reply button on my email to Victoria at general@rpmspain.com and informed them of my dissatisfaction with the short notice of this meeting and informed them I considered this typical of the way PW treat owners. (The full content of that email you can read in my post on this thread from yesterday) The response I received is below, it is difficult to read but posed some questions to me:

 

  • Who is RPM Spain who the email notification came from, if nothing to do with PW?
  • Who appointed RPM?
  • Have we been informed of the involvement of this company?
  • From the comments in the below response it is clear they consider owners from other country’s can lump it if we don’t like it?
  • I may be wrong but are owners from other country not the majority at condado?
  • Although we do have to operate within Spanish Law, is it unreasonable to ask for consideration be given for the logistical problems of overseas owners (reasonable increased notice of meeting where possible)? From the below comments RPM don’t think so
  • Don’t we require a management firm that represents all its owners?

 

This is the email respons I recived from my email question

First of all i would like to inform you that we are totally independent from Polaris World,so please do not blame us for Polaris World mistakes, becasue we are in the same ship so please try to inform you about it. My company is in charge for the management for the whole complex. And as well I would like to tell you that this are the incovenients that you could find if you buy a property in another country. You may check the Spanish Law and you will find that we sent the email on the right time period. the agenda for the meeting will be the following:

  1. Information about the organization of the Community of Owners, outline and operation of Community levels.
  2. Information about Annual Accounts and budget for the Community. Distribution of the budget according to the Statutes.
  3. Renew, if approval, of the Community representatives: President, Secretary- Administrator.
  4. Any other business.

I would presume RPM have been put in charge of managing the resort, someone has to and I can't see how the owners could collectively choose or decide on selecting an appropiate company to manage such a huge resort from a standing start.

RPM will manage the resort and then when the community graduallty takes control we will have the voting power to stick with them or dump them, let's give them a chance, they haven't even started yet!!!

I agree Phil the email is a bit abrupt but maybe it has been lost in translation, these problems of short notices are very common looking at other forums.

Reading into it they will just announce our budgets for the year and then later in the year we would vote in mini community presidents to take a more active role etc.

Thats just about what we read into the information too Dan. Seems to be the standard set up for Polaris resorts, in that PW appoint a company because its not possible for the residents to do this in the first instance- then once everything is established the residents begin to have more say on whats happening and what it can cost. Just hoping the monthly fees havent spiralled as no doubt the persausive 'about 50 euro's a month' speech we got during our inspection visit isnt going to be accurate now!

The appointment by large builder companies of a management company is not at all unusual. in fact its a common thing.in Spain

Rightly so we as "people from other countries " have to realise we can`t have it all our own way.

We expect "people from other countries" to tow the line when they come over here , so why do we moan when we go to live or to own a place abroad

As for the Spanish people being the majority owner on Condado. I think we will find that it is the case.

We have a lovely young  Spanish couple living  below us. They said the apartment to our right is also owned by Spanish. We are an end property but the couple think that the owners of their neibouring apartment  are also Spanish.

Living with Comunity management is nothing unusuall to the Spanish . So I think that If you are over  either taking a break or residing there it just might be a good idea to get  your Spanish neibour to explain the way things are run & maybe we will find we are panicing  over nothing ( I hope )

I Know there is a Spanish representative on the Committee for Hacienda , My neibour says he is very nice & looking at his photo I have to agree, Sorry Ham , Just Kidding . Not

There is a site for Hacienda  which I have posted on another thread last night. I think you may find it interesting.

Sory cant give you the details again as Ihave mislaid the paper with it on.

We heard alot about the PW Spanish adverts for Condado from our friends and agent- they said there were great expectations that a high percentage of occupancy would be Spanish. From that point of view community living is much more what many Spanish people are used to, whilst to us its unusual. But I dont presume that people from the other countries and backgrounds will actually want anything managed too differently than the rest of us. I have read on threads/forums people writing about 'not being told what to do and what they can do to their property''  thats a very natural reaction except that the viewpoint is 'for the common good' and part of buying on a resort community. Fortunately only one resident has built an unusual structure on the roof! I hope after the intial set up a lot of worries are put at rest and the basic concerns can be dealt with:- for example, dogs on the resort seem to be a recurring theme and maybe if they really are a problem the community can deal with that once and for all, amongst other things that crop up. We were told the lights would have to be uniform and no washing can be hung on the roof or on terraces or over balconies and only white or cream canopies, no sky dishes- so maybe these things will finally be clarified.

I think some of the things that are bothering people may be more to do with dealing with Polaris and what they do and dont do when problems arise with the apartments. I dont know if the community representatives can act as advocates in dealings with Polaris.

On our development, we had our first meeting in March 2008, where we were given minimal notice - probably about 2 weeks.

Subsequently, we had 2 further meetings in June & September where we had the same issue. However by working closely with the President & the Administrators, I managed to get their agreement to surveying the whole community for their choice of date for the AGM in April.

The survey was undertaken in November & the agreed date published on our community website by the 24th November, in time for the release of summer flights with the budget airlines. Last week, the administrators sent out an email adbvising teh date to everyone - the meeting is still 9 weeks away on the 11th April. The formal agenda will be published about 2 weeks before as usual.

In your election of the officials, I would recommend trying to have both Spanish & English speaking as this breaks down the barriers. Secondly, I recommend building good relationships with you administrator/site manager - basically anyone who can give you information.

I am the VP of our development & I keep over 150 owners regularly upated on events that are taking place, including building issues, gardening problems, pool problems etc.

As for your proxy votes, you do need to try to get someone to take your vote. Not necessarily for the first meeting although this may help in getting your representative of choice elected. For future meetings a joined up approach means that you will be able to influence decisions that are made affecting the whole community. I have done this at teh 3 meetings that we have had, holding up to 80 votes at a time.

It does take some time & effort to organise but it is well worth someone picking up the baton.

It would have been nice to have been informed about this, but to date I have received neither an email or letter , despite PW having previously contacted me by both of these methods. Is it just me ?

On the point of proxy votes, presumably we would have to fill some paperwork in or at least notify somebody within a certain time limit if we were going to do this?

Thanks Norman that is some good advise. 

I haven't yet received an email either , maybe it will come through eventually.  I think this first meeting will be carried out and the people who can make the meeting can also represent people who cannot make it, i can't see any paperwork for proxy is going to be done.

Please don’t misunderstand me, I am aware that it’s the norm for management companies to administer large community for the residents and think this a proper way of doing things. In fact similar happens in the UK on some development and is becoming increasingly the case.

I don’t think anything should be done in any other way than the Spanish way (When in Rome).

I hope the Spanish are the predominant owners, as this would be good for all of us, as they will not stand for being mucked about like we do and they will better understand the way things are and should be run and hopefully ensure they are run to the benefit of all.

And I definitely agree that Spanish people are lovely people, I wouldn’t be buying a property in Spain for personal use otherwise if I didn’t think this.

The point of my previous post was about being kept informed and consideration of all owners circumstances where possible. If thing progress as Noreen indicates this would be good. I just considered 15 days or less notice for a first presumably non urgent meeting to be inconsiderate of non resident owners Spanish or otherwise.
