Hi - Is there anyone out there who reserved on what was the original phase 2, and has managed to secure a refund?

Hi Dimala,

Unfortunately we are in the same boat as you. We have paid 42000 euro's for Plot 2760A which still has not been started and we signed contracts back in Nov 2007. Polaris have offered us a change on another part of phase 2 with a 40000 euro discount which building work has started and growing at a fast pace however we have decided to hold off for our original penthouse or money back but we dont know how long it is before Polaris are faced with refunding us. Some of the owners on phase 2 have been notified that their houses are definitely not being built and they have been offered a change or better still a full refund. We have been taking advice on the forums which have been very helpful and hope we have a positive outcome at the end whenever that will be. If we have anything to feedback then we certainly post it. We got a full refund of our money in September.  We were shocked. We had a very good Solicitor in Spain but in June/July last I took the bull by the horns and spoke to Polaris themselves.  I demanded my money back and very shortly they phoned me back and offered me alterative key-ready properties on another site but at the same price as I was paying.  I checked websites and these properties were selling for at least Euro 40,000 less.  I asked them did they really think I was stupid.  I said I wanted no more contact from them and it was now directly in the hands of my Solicitors (who they had ignored for pratically two years).  Within weeks I had my money back.  I also threatened to post several letters on websites warning them about Polaris and I also said I would camp outside their sales office.  I did mean this!  We got our 40,000 back.  Be firm and get a good Solicitor.  Best of luck.  Eve Kate

We got our money back in full in September.  This was after two years of waiting.  The whole novelty of it had been ruined for us.  We had a great Solicitor all along and in June/July last I got really mad and phoned Polaris myself and asked for a full refund.  They phoned me back and offered me key ready properties on another site but for the same price as I was already paying.  Having checked on websites and looking at re-sales they were selling for Euros 40,000 less.  I asked them did they think I was stupid, told them  not to contact me again but only my Solicitor.  I also threatened to post letters on websites about my experience and also to camp outside their sales office (I am not sure if I would have done this but it sounded good!).  My advice really is to get a very good Solicitor and also to hound them on the phone and be  very very firm.

Congratulations Eve Kate, not many have got that result as far as I know.

Hi Mikey, when you contacted me I did understand that you were on the old Phase 2, had I done so my advice would have been very different. If you are actually on the current phase 2 be careful & get good legal advice before you throw money at trying to recover your deposit. My understanding would be that the Old P2 was cancelled and therefore people were entitled to a refund albeit PW weren't going to volunteer it.

If you are on phase 2 I will hopefully be having the disc ussion soon that I spoke to you about & will post anything useful on my blog.
