Hi, I assume the Agenda has been posted on the board as BDM.    For those not present to see it can we get the agenda on this blog.   I'm sure everyone would like to know what is going to be covered.      There was a great deal of discussion at the meeting held in Mano's a few weeks ago and plenty of points that should be included at the AGM.

Hi,

The Agenda was included with the last Home Owner's Association letter dated 21/12/09. It is listed as:

1. Management report.

2. Current situation with the builder. Decisions to be made.

3. Approval, if granted, of the accounts for the financial year 2009. Listing of debtors and sums owed and decision to be taken regarding legal action.

4. Budget for the Financial Year 2010. Fees and payment periods for these.

5. Any other business to be raised.

A statement of income & expenses for 2009 was included together with a debtors list for 2009. (Note: If you're not on this list and if you haven't paid your fees for 2010 (or part thereof) you are not entitled to vote at this AGM - even though you haven't received a bill for 2010 (or part thereof).

Although points were raised at the EGM called in Mano's, there has been no official notification of issues raised or extra inclusions in the agenda. But one would assume these will be raised today and that we'll all be notified accordingly.

Hi All

to clarify the meeting at Manos, it was not an EGM that can only be called with the presidents consent and would need by law to be sent to all owners. I called it for all on site to try and find out the English speaking residents point of view and try and minimise the amount of times I get stopped and asked the same questions and I try and keep people informed like yourselves by using this forum. None of us has had a bill and todays meeting should be there to approve the budget for 2010. We have had letters to tell us what our debts are and a fine of 300euros for not paying before FEb 1st . For the people not getting any mail please advise the administrator of the address they need to be sent to. For those not aware we as a community have still not paid last years fees as of 30 Dec there was still a shortfall of 26,000 Euros, hence so many problems. Some of the people on this site are debtors for 2009 and others paid late December 2009. We know we have fees to pay so I would urge you all that have not paid or had your correspondent to get intouch with admin and correst it. Spanish law apparently will not accept having no correspondence as a defence, so we will get fined. I´m sorry I can´t change that. What we are hoping to change tonight is the administrator to one who will take your points on board, the current one shows irregularities in our accounts. When I know whats going on and if we change I´ll send is email by this forum.

Thanks Alan. I think that because there was a reference to EGM being called and then a subsequent meeting in Mano's, most people thought they were one and the same judging by the various postings. An EGM was called but whether it took place or not was not clarified.

I totally agree that you should not be stopped continuously and having to answer the same questions. It's time wasting and frustrating. I think It  also leads to too much hear-say. I personally know that you are very good with keeping everyone up to date and it is much appreciated. But you shouldn't be the point of contact for every moan and groan in relation to the development itself.

As you say, there were no bills sent to any residents in relation to monies owed for 2010 and I think people are concerned that they are being regarded as a debtor accordingly. This needs clarification.

People are aware of debts for 2009 and yes these debtors do need to be reacted to quickly. If fines are not paid within a short time frame, then owners need to be  pursued for compensation. These people are part of what's stopping us from doing what needs to be done for the development itself.

I hope everything goes well today and we can start moving forward. Slowly but surely!! Well....not too slowly....

Hi All

I would like to thank all the people who sent there proxy votes both to me and other people, it as enabled us to vote off the administrator, The meeting was long protracted and cold with lots of emotion, the promoters representative walked off site he was talking (my opinion) a lot of garbage. I believe we agreed to carry on the legal route and that we will look at the COMMUNITY snags again and add all the problems to it that have arose since the initial list was put out. The builder as taken into one apartment that has suffered more than most with damp, the promoter said that they would hav to repare the concrete to make it water tight. We voted not to accept the accounts as there are things we are not happy with. Fines for non payers were discussed and it was agreed that defaulters for 2009 should be hit with a fine. We are in to 2010 and agreed to be a little more sensitive due to the fact we hadn´t voted on the amount. There was discussion on the amount payable, resulting in a general agreement to pay the same as 2009 but to check that the amount is correct as it was suggested there are anomalies. Anyone who hasn´t paid for 2009 I´m not going to apologise for the fact you will be fined as per Spanish Law. 2010 we have a little time it will  be discussed at next weeks committee meeting. I would sk all of you to now send me your details were you want your mail to be sent so I can pass on to the next administrator. You won´t get a bill straight away till we sort out all the revised procedures. I am however going to ask personally that  you pay half of this years fees based on last years figures to enable the community to pay its obligations to maintenace, cleaning etc. The committe will endevour to atisfy your wishes and get bills

 Thanks for the quick update,  hope all goes well in getting another administrator soon,we paid our first half of 2010 years community fees in january as advised and did recieve acknowledgement that payment had been recieved.

Thanks for all your efforts Alan and keeping us up to date we paid our fees in January by direct debit but we probably need to cancel it now in the Bank if the Administrator is Finished. Our Postal address etc is with the old administrator as most peoples would be so he will have to hand over to the new I would Imagine.We will be over in April.

Hi,

I paid my 2009 community charge and have the receipt so was a surprised to receive a letter from the administrator today demanding payment , plus a 300euro fine.     He is also requesting payment to his account.    So firstly this is clearly an error but I am more concerned that others may be asked to pay him directly rather than to the community account.

I have no issue in paying half of this years money as I agree we need to get some funds in to keep things running.   However, can it be confirmed that the administrator has been removed from the signatory on this account.   I do not like that he was the sole signatory before and now this is even more worrying.

Hello All, I have paid my fees, which I struggled to pay as I was given the wrong swift code for the bank.

I too have recieved a letter from the administrators trying to impose a fine of 300 euro which I have no intention of paying as this was not a mistake on my part. If you are supplied with the wrong information.

I hope this will be rectified when the new admin take over.

Hi All

for all who paid last years fees there is no fine so don´t worry, for those who didn´t pay 2009 the you will be fined as per last Julys EGM. For 2010 the admin sent letters out without permission and prematurely disregard the 300Euro fine for now. The remainder is the first installment for 2010. The  Admin is not a signator on the Bank account so pay by transgfer to the bank, do not send or give to the admin direct. I will update the situation after committee meeting Monday Night
