If the asset you get has a mortgage or a charge against it - how does that effect the auction?. Presumably you now have the responsibility to pay off any charges before you benefit with any oustanding money.

I understood - that most Huma assets were mortgaged to the hilt or had charges against them and this was the najor problem we all face now without Bg's.

Hi All

We were told by our solicitor in September last year that our seized plot would be going to auction by the end of the year, ie by Christmas, but we heard nothing. I e mailed her in the new year to ask the outcome of the auction, only to be told that the valuer had not put a correct value on the plot so it had not gone to auction after all. It just seems to be one excuse after another and now 2 years after winning our case we are no further forward.

Most of you regulars will know that I have been contacting everyone I can think of ie newspapers, TV, MP's etc try to get some support for us all, but no one wants to know. I e mailed the Mail on Sunday again in December as a few weeks before Christmas, they covered a story of a celebrity losing money on a Spanish property, and that is the second time in 12 months that has happened. I asked them if a story was only worth publishing if it concerned someone famous. I have yet to get a reply!!!!

I have however had a reply from the European parliament via The British Consulate in Malaga this week and I will copy a quote from it for you all. It says:

"Although we understand the distress caused to some British citizens by property-related issues in Spain, the British government has no authority to get involved in any matters concerning Spanish domestic legislation, whether national, regional or local" 

It then goes on to warn Brits about the differences in law in Spain and advises that we take independant advice. I really don't have words to express my opinion of these comments.

The letter does give an address and phone number for The European Consumer Centres Network, and suggests we ring them for advice. If a lot of us ring and make a big noise it may just help our case. I will give it a go and if anyone would like the address or number, send me a PM and I will let you have the details. Also the letter suggests we write to the president of Andalucia, although I think a lot of you may have already done that, but again I have the details if anyone would like them.

I will continue to push to get someone to listen, but I am constantly hitting a brick wall and I am sick of being ignored. More drastic action is needed and any suggestions are very welcome. We will keep fighting!!! Good luck to everyone. Lin and Tez

Re mortgage or charges the answer is no it does not have any outstanding.

There is a lot of false information being given out to cloud the issue and peoples judgement.

Things like charges on all properties, the Spanish legal system.

DO NOT BE AFARAID TO TAKE HUMA TO COURT.

Infact the more that do the greater the chance of their activuties being publicised and our voices heard.

Be honest, nothing else has worked and what have yu got to lose now at this stage ?????

The media choose to ignore us because A Place in the Sun and the TV/newspaper advertising are very closely linked -

in other words lining each others pockets. They rely heavily on sponsorship and advertising, even more so now as TV budgets are being cut.

We have tried to bring our problems to the attention of the foreign office and the british embassy with no result because basically there is nothing in it for the polititians. They say they can't get involved , which means they can't be bothered. Just look at the Priors, no home after all this time, no-one from the government has done anything to help them, as far as I know.

I believe that Huma have funds stashed away somewhere where it can't be retrieved, it's a real shame that those who transferred to OCC have been conned twice.

Your not going to beleive this but aldea have just sent me a bill for 6 Euros saying they've gone to the wall and they want the money now....Those Fu****g Bas****s should be put up against a wall and shot.....I replied to them wheres my 30 K plus interest that they owe me back...

In the meantime I will tell you about Pickle.

Pickle was a member of the original ACC Forum in 2004-5.

He posted continually that ACC was a sham, it wouldnt and couldnt happen.

He got absolutely lambasted, kicked to death, stabbed over and over, he was even suspended from the Forum for a period !

He didnt post after that, but I feel really guilty that he was treated that way. He was 100 percent right.

I would love him to post again just so I could say " Sorry Pickle you were 100 percent right".

How did he realise, and no one else, what the score was ?

I am with miguel, he is in the process of taking aldea administrators and those responsible for looking after my money to court ..I am going for criminal damage..we are not messing around and want a result.. money back or jail! watch this space

Certainly, when ACC building stopped in late 2005 (i believe from memory) those people that decided to withdraw then and in 2006 were, and did, get all their money back very quickly. In a few cases refunded with interest and costs.

But in 2007 / 8 things stated to change and it became much harder and more complex to get your money returned. Every barrier known to man was put in your way to make it very drawn out and difficult.

Then as the down - turn started to 'bite' the money was probably used on 'other' things leaving us all high and dry to fight on and take the legal route.

It's no consolation to anyone that is trying to get their money back, but, what I would say is that the Spanish are now paying the ultimate price for all of this as the property market has crashed beyond repair for many years, tourism down at all time lows (airlines stopping winter schedules), taxes costs etc  rising out of control .....They didn't ever think about these things when they were taking the money from us did they..................no they let the developers just do as they pleased.

Yes you are totally right the sensible ones got out early and got their money back the rest of us (those without BG) are just trying to find any way to get our money back.  I think in the early days HUMA would pay any one back as soon asthe 18 month contract date was passed - this stopped when it became apparent to HUMA that there was a major problem with the licenses.

Yes we did get 1 BG refunded in 2008. Huma still owe a refund to us for the first instalment we paid (April 2004) them and didn't ever get a BG ! So this has gone into litigation and we will fight for compensation, all costs, interest etc  etc...........

We have also given Huma several chances to settle out of court for lower amounts just to close the issue. But they do not even respond to that request so we WILL see them in court one day ! and we WILL get our refund.

So  - Mr Huma -  I and I'm sure many others hope you are reading this because you will never get off the 'hook'................that plot on ACC has my name on it until you refund all monies owed.

We were one of the lucky ones we started proceedings in Nov 2005 and got everything back with interest and costs in May 2007.We did give plenty of people our solicitor but because of their fees may have put people off it did not do that to us Unfortunatly those who asked our advise at the time etc are still waiting,

We went to court and on thday of the trial Huma coughed up!! Even had a nice outfit to wear!!

I read these messages and my heart does sink and I feel for you-on the note of Pickles never heard of him but we did no of Anna She got out right at the beginning and she was bombblasted and kicked of forums as she more or else said the same as Pickles!! how right htey were.

hi everyone,just read through the latest posts,there is an awfull lot of people in the same boat,and your right who said the clever ones got out early our friends did and they bought a place in san juan.they have been there 4 years its quite nice its called beverly hills its on the mountain side just back from the beach they were told no one would or could ever build in front of them ! guess what 2 years later they have built right in front of them and they could not have packed more in if they tried,ruined the place,so you never know maybe waiting and fighting for your refunds isnt such a bad thing as long as you get it in the end and you can afford to wait and pay the legal fees,one thing is for sure you would think very hard before doing it again wouldnt you.ours is at court waiting a response from caja murcia who we have several bank guarantees from, been fighting for it with the solicitors now for 18 months, plus we asked for the refund ourselves 6 months before that, bought in 2004 oct i think its now so long i struggle to remember.shame because it would have been lovely,anyway keep battling the bastards, they must not be allowed to get away with anything.please post if you have any positive news as well as bad it gives us all hope.

I think that Anna and Pickles were the same person.  I remember that she posted on a number of sites around 2005 and yes, she was one of the first people to get a full refund. She also got her 3000 euros initial deposit back which since then has been almost unheard of.  

Can anyone else remember her ?
