Legal Action against Roda/Calidona.

Hi Everyone,

Does anyone know the legal status of the 'Bank Guarantee'?

The one I have infers that if my appartment is not completed by a certain date, then my deposit is refundable...........sounds OK on paper, but what is the reality?

To be honest I would rather have the property completed and enjoy my retirement at RODA!

Hi KDG, your bankguarantee may infer a date but that's about it.  I believe that if you check your contract then it will probably say that completion will be within 18 months of the granting of the building license. 

If your license has been granted then calidona should have contacted you to inform you of this and give you a rough idea of when completion is likely to be.

According to law, bank guarantees are legally binding until you have completed but i would however take the necessary step to re-new them if they are due to expire soon.  Do this by contacting both your solicitor and Calidona at least a couple of months in advance - hope this help - Russ

The meeting of Roda owners considering, and also in the process, of taking legal action against Calidona is now set for 13th March 2010 in the Midlands, UK. at 10 am for 10.30 start. 

We already have enough owners attending to secure the attendance of a prominent Spanish solicitor and quite possibly a litigator to answer our questions.
