Interest-ing section of the eeuu by-laws concernung late/non payments of community fees. An immediate 20 pc hike and then legal action against non/late payers.
In the case that any associate has not made the payment of the community fee quota, either an ordinary or extraordinary quota that has been approved by the Assembly, as soon as the payment date has expired, the Directive Board can request that the Administration proceed with legal action to obtain the debt including any interest and surcharges that correspond to it, in virtue of what is stated in the Article 70 of the Urban Management Regulations, it can also be claimed via the civil jurisdiction.
This way and taking into account what is previously stated, once the payment time period has lapsed, without the payment being made, the owner will automatically be obliged to pay a surcharge of 20% on top of the nominal unpaid invoice/s, under the concept of compensation for damages generated towards the Entity, this surcharge may be claimed, should it remain unpaid, through the legal system
Previous to this the Directive Board will communicate effectively with the member that is a debtor and if the debt is not liquidated within ten days of the reception of the notification, then the Administration will be sent a comprehensive certification of the debt to proceed with obtaining the payment legally.
