Very interesting news Chris.
I take it this is a separately formed small group action against Calidona rather than the 'very large' group that are/were supposedly going to take action.
I have just had confirmation that there were two more completions today and another six due to take place in San Javier on Friday of this week.
Let's hope that between people taking action and the income from completing owners we can coerse Calidona into getting on with the promised facilities a little quicker than they are at present.

This is very good news that people are completing. As a person who has completeed on Corvera im glad to hear others are too. Do you know how many apartments there are in phase 1 and 2 how many are sold and how many completed or any data like this. I think British people who are taking on a Spanish company in Spanish courts are crazy i dont see how they can win.
As a phase one owner i always thought the last thing to be completed was going to be the hotel and thge facilities that come with that. Although it will be good when there are a few more bars and restraunts open but this will only happen as people complete. Its going to be a hard year for everyone but i really hope that this place will be finished to a high standard and soon the rentals role and property starts appreciating.

Hi Iain - when we were out there at the weekend, we heard (anecdotally) 1100 properties built (I assume this means on P1 and P2), approx 900 sold and approx 300 completions to date, so about a third completed so far.
We share your views and it is good to hear completions are ongoing.

Just as a follow up for people only just coming onto the forum.
The people at Calidona are saying that they are winning ALL the cases that have been brought to court so far including those that have gone to appeal.

Steve , i dont like shooting the messenger but im intrigued by this comment.
I would be extremely surprised if any time valid cases had got to appeal yet unless the judicial system in Spain has gone from a state of collapse to the most efficient in the world!
however , these are probably the same people that told you this that also said my apartment would be ready in 2007 and that it would be a on a 5* resort, with a devere hotel, clubhouse, health centre, business centre.... i think you get my drift !!

When did you ever think the hotel would be finished before the phase 1 and 2 properties? It was always clear that the last thing to be completed was going to be the hotel.

Just to add a little more balance to this debate -
So it seems they have lost the government / EU subsidy which they applied for on Corvera as they did not put enough capital / build enough facilities on the resort. To my knowledge they also applied for a grant to contribute towards the building of the hotel on Roda. I do not know what happened to this but assume there has been a similar fate.
These grants were originally awarded because of the long-term employment prospects they were meant to create. In the case of Corvera I understand that this was meant to be in 62 permanent jobs.
So whilst it is probably inevitable that people will lose their court battles in the local arena when up against Corvera. It does seem that judgements such as this one underline the obvious point that the resort has not been built as promised to the purchasers or indeed the grant awarding body.
Blaming the non-delivery of the clubhouse on a lack of completions is a nonsense. Asking decent, hard-working people to invest more of their life-savings into a project created by a business with such a poor track record of delivering the promised facilities is despicable. The chief executive, Jose Luis Perez Ros is not short of capital to invest.
In December 2009 it seems that he set up a new construction company with nearly 66million euros of capital -
To me the rules of this game are obvious – if more people do complete, then there is of course a greater chance of more facilities being created. But as Roda has shown, there is still no guarantee of this.
The directors of Calidona have seemingly protected their funds and will not be taking any risks other than providing facilities with relatively low sunk and start up costs.
So in my opinion if people are considering completing they should only do so on a price that they may deem apt for an apartment or villa on a resort that falls well below what was advertised. Do not expect anything else from it and you should be able to enjoy it without the stress of thinking what should be.
PS in terms of when the hotel should be built - on Roda the foundations were created years ago and press releases were created by Calidona in 2006 that the hotel will be ready in 2008 (also backed up by De Vere at the time). As we know, Roda is still not a complete resort in terms of apartments or facilities but the initial attempt to build the hotel was there as was the grant application.

Yes, great informative and balanced post Mr U. i think you have pretty much hit the nail on the head.
Iain in response to your question , the hotel was/is just one part of the 5* jigsaw that when complete would be the great end product that was sold to us all with such gusto and impressive marketing. The problem is so many of the other pieces are still missing so where as there are some out there that are prepared to take a "leap of faith" ,there are also quite a few of us that are not.
There are no wrong or right answers here between those that have completed or those that havent, just differences of opinion. i will stick my neck out and say the only ones that have given some wrong answers are our good friends at calidona.

When the directors left Polaris and formed a company it was Calidona developements not Corvera
If Calidona are the parent company and have ceased trading they will not show any debts or have creditors as the 2 subsiduries will carry the debt
In either case I think the future looks very bleak indeed
