I posted the following on a previous thread and no one including Tony has given me an answer - any ideas?:

We haven't been on this forum since we were horrified that our deposit would not be given back to us many months before San Jose had their 'problems'. This, to us, proved what robbing people they are. However, after reading many of your comments and agreeing with the likes of Hewi etc please read the following and if you have answers we would be interested to hear them:

Our solicitor has advised that Herrada Del Tollo (HDT) has assets on it’s own books valued at €361 million. OK, the value may be overstated and many will be mortgaged but why is the feasibility plan prepared as if this is a new start up ie with no opening balances? Although we’ve probably lost the lot, we are being asked to write off a third of our investment to save an existing company owned, incidentally, 50% San Jose and 50% Inversol. If there is genuinely nothing left in HDT then how can anyone have any confidence that the same people are going to somehow be able to make this 5 year plan work? 
 
We want our money back but cannot for the life of us trust these people!

Don`t have the answers you are looking for, however you can bet that any assets they have are being spirited away while we wait on the judge giving his ruling on June first. Some people are choosing to ignore everything this company has done to us and place their trust and money for another God knows how many years. They have proved time and time again that they are liars and I agree with you, they are a bunch of thieves. Cheers Joanniemac

Hi Hoyes,

I am sorry if I missed your question I have been rather busy  replying to SARC members etc.  Firstly HdT are not "spiriting away" any assets, as any action that they take has to be sanctioned by the adminstrators and the court.

Secondly the reason there is no money mentioned is due to there be a negligable amount. If you read previoud reports on the SARC site you will see that a small amount of land was sold to the town hall in Calaspara to give HdT funds to cover running costs.

At the meetings HdT have explained how the plan works, how people get paid back and that they have to comply with the plan & will still be under court supervision.

As for trusting them, SARC have stated that if SADM is going ahead that we will closely monitor what is going on, report it to our members, post it on the SARC website and do all possible to ensure complaince with the agreement.

Sorry for taking so long to post this.

So Tony I suppose the asset stripping of the San Jose Apartments in La Zenia, is not "Spirting away" any assets only complying with the wishes of the administrators. Get real!!!

Dave don't waste your breath I saw Tony in action in Newcastle he is true blue "San Jose " star spangled banner and all .You are wasting your time the guy is star struck  and if you ask me , just plain stupid !!!!!! Asset stripping !!!! you bet your ass they are !!!! and not just HdT !!!!!!! Best of everyone  !

I donot think that you really should speak about the le Zenia Apartments, do you?  You know that they are an SJ and not HdT asset.

Hi JA,

I get that you are not a creditor, that you have no money to lose, that you are only interested in creating mischief and do not have the best interests of others on your mind.

All being well we will get the vote & SADM will go ahead and then we can start the process of collating the advice and behaviour of solicitors and provide the ombudsman in Alicante with our findings.

A couple of question to anyone "in the know"

1. HDT/SJ did not issue bank guarantees and cancelled an insurance bond covering our deposits, Effectively breaking the law. The couts did nothing, no prosections, no help for purchasers. How do we know they will help this time round??

2. What power do SARC have to "closely monitor" or "ensure compliance". What exactly can they do if it all goes pear shape again? Post the bad news on the SARC website??

I was under the impression that a company had to obey the laws of its country. I did not realise that stealing thousands and thousands of euros from innocent people was classed as a first offence and the courts would just say don't do it again cos we're watching you this time!!!!

As JA would say "it beggars belief" and she is spot on

Yes I know the La Zenia apartments are an San Jose  asset but if you also remember back when this all went tits up the Company San Jose only wanted Hdt to be put into administration but the Judge and courts said "No Way" they are all part of the same company.

So yes the company are asset stripping!!!

Our understanding is that the Banks have now also re-possessed every single unsold property on Playa Golf.. so there's a few more assets gone.  We exchanged onto an alternative property having been warned by our excellent Lawyer that this was imminent action back in February.. he was right on the button.

While under administration they were given permission by the courts to continue to sell properties some time ago,  however as almost all  of their properties were mortgaged years ago, most would have been repossessed by the banks anyway.  And I doubt if there was any change left over for the creditors.

Also, as CAM Bank are their largest creditor owing them over 9 Million, and being one of the Administrators in the team of three it is easy to see where the deal was drawn. 

Roll on June 1st....
