Hi All,
I am new to this forum as of today. I am like all of you in the same situation. I have recieved money back for the payment that was covered by a BG as soon as i cancelled my contract.
The 2nd phase payment is another story! still fighting with Fuster solicitors.... Is anyone else with Fuster solicitors? I am being asked for more money as well even though we apparently won the court case, Huma didn't pay up, and now we are waiting for them to seize and sell the assets..It all gets very confused, and I think the solicitors just want money. I am not paying them anymore!!!
I think the only way forward would be to take the banks to task who did not issue the BG as per contracted to do so.... anyone done this??
I almost gave up as its too stressful but i cant afford to lose this money, thats what they want us to do!! i emailing and calling my solicitor monthly but now he doesnt even answer my emails for weeks on end!! not like they are busy with Sales is it!!! they just know we are not going to get our money I am sure....
Ready to fight agin any way we can I am in !!

I'm talking to so many people on here i get confused, I thought he didnt have a B/G for the second payment, and he is using the same solicitor as us, thats why i don't understand that when we suggested this he said no.

We are in exactly the same boat as you, yes we are with Fusters yes we got one stage payment back. But have 2 more outstanding which we are not having any luck with the solicitors are hopeless. We are hoping everybody concerned will now form a unit and go after the banks
This would be the only money we would be prepared to stump up now, we seem to have gone as far as we can go we've won the court case against HUMA which amounts to diddly squat......

Tasm,
I wouldn,t pay your solicitors anymore money,you have your judgement against Huma,that should be enough but as we know it is not.
As for an embargo on there assets,,well it would appear they have none or if they have they are well out of the reach of normal legal enforcement!
Have you asked Fusters about legal action against the bank?

Hi all.
Thanks to all who joined in the group action against banks.I'm back on the scene ,baby here now all safe and sound ,although nanny to four so no time to breath lol. But I am waiting now on a email to give us an estimate of how much it will be,Fingers crossed we will get good results. I'll let you no as soon as I hear .from her. Please could all those who have sent their forms back to her let me know so I can tell her the final numbers.

Hi All,
Well i asked Fusters about legal action against the banks, and guess what ....they ignored the question and only informed me once again that ' Progress is very slow as the courts are very busy!' that was it...
I have replied and asked them to answer the original question yet again....
Is it too late to join the fight against the banks that you are discussing before i joined the forum?

HELLO WE HAVE NOT POSTED FOR A LONG TIME, OUR COURT CASE AGAINST HUMA WAS WON, HUMA REFUSED TO PAY, COURT DID NOTHING TO MAKE THEM PAY,SOLICITOR WENT AFTER HUMAS ASSETS,FOUND NONE,TOOK HUMA BACK TO COURT, STILL WONT PAY,NOW SOLICITORS HAVE FOUND A HOUSE ON MAZZERON CC WITH NO LOANS AGIANST IT, AND NOW WANT MORE MONEY ON TOP OF THE 3000e HE HAS HAD TO DATE, I BET THIS SOUNDS FAMILIAR TO MANY BUYERS,,
WE HAVE BEEN CONNED!!!!!! HOW HAVE HUMA NOT GONE BUST, DO THEY BRIBE THE COURTS,BANKS ANDV LIQUIDATORS???

It appears Spanish solicitors are mostly on the make as well, are there any genuine ones????? They all just want to rip off as many as possible, crooks the lot of em. They ought to become MP's!!!

I tried to change solicitors to a man who my family use in Spain (they live there) and he seems genuine, in fact gave me free advise before, but it isn;t fair to use someone for advise without paying....so i decided i would swap sloicitors as Fuster are rubbish, and guess what ... Fuster informed me if i move to a new solicitor, that i would have to pay all the fee's acrued so far that are being claimed from Huma if they succeed! i am obviously not going to do that so I am stuck with them! unless anyone knows they are again telling more fibs! and this is not actually true.... as far as I am concerned they have not won.... and wont win this case ffor me, so why shouldnt i be allowed to move....

So what are you going to do. My solicitor cant find any such property - if it was me I would take the chance and pay him the money. If you don;t you will always wonder what if?

Hi Tasm,
I asked Fusters the question about taking action against bank. Guess what, exactly the same response as you! They ignored my question and sent out what sounds like an identical email to yours saying that progress was very slow etc. Sounds like they can't even be bothered to write individual e mails. What are we paying for?

Well this all sounds firmiliar,i too have had the same response from fusters and they failed to answer the same question!
It,s as if they take us down the court route to obtain the maximum fees from you fully knowing the outcome will be zip! rather than being honest and up front and saying from the outcome there is little or no chance of getting any money back.
I could understand it, if it was a legal requirement before takeing action against the banks,but is it just another way to extract the maximum ammount from each client?

I agree with the comments re Fusters, they take an age to answer my e mails, we are at the stage where we will not part with anymore money, but have no idea what if anything will trigger a positive outcome, ie recovering about £45000 in 2 stage payments with no BG.
After all we gave the money to Fusters!?

For all those who are using Fusters can I ask is this the same Solicitor who you used to buy on ACC? If so perhaps it might be worth asking them in they had Professional Indemnity Insurance as they wrongly advised you in the purchase on ACC and you are considering suing them. Personally I think there must be a case against the Solicitors for bad advice - but I am told that an action against the Banks is more likely to succeed than against the Solicitors.

Yes I used Fuster to purchase on ACC along with Parador properties, who also didnt want to know as soon as it all went wrong!
Suing solicitors will always be a costly and difficult process especially from the UK... :(

We too used Fusters to purchase on ACC and also went through Parador as TASM says being in the UK and totally remote from what is happening is so frustrating, but to be honest we got past the frustrated stage ages ago and now just feel conned...

Yes but maybe if you ask them about their PII and about suing them they may be a little more interested in helping you (in their position I would be a lot more helpful).
