Hi There
We are in block 37 phase 2 and ever since completing there has been an ongoing problem with the lift breaking down. We have had 2 lots of guests staying in our apartment who have been there since the 23 rd of July and the lift has not been working since then. Obviously these guests are complaining about the inconvenience but are now asking if there is anything we can do about it. Basically, I have tried phoning a couple of numbers I have here of housing administrators including a number for Marisol but have been unable to get a response.
Is there anybody who knows anything about the lift situation or can give me a number to contact.
Any help most appreciated.

I am sorry I have no idea why there are continuing problems with the lifts in your block, we do pay a not insubstantial amount for a lift maintenance contract which is administered by Housing.
I cannot explain why you have had no response but as a reminder

Dear All,
Inside every lift on Roda is a telephone number for the respective service company. In phase 2 they are maintained by ThysesenKrupp, 0034 968 321 232.
I have called them on numerous occasions for issues with various lifts and they have been extreemely efficient in sending someone out, the same day.

You are quite correct the maintenance company are normally very good, however in this particular case I have been informed by the Administrator that the problem is associated with leaks in 3 of the lift shafts in Phase 2 and it is so dangerous in block 37 that the lift has had to be switched off.
Roda have sent people in on a number of occasions to repair the original problems but apparently it has still not been attended to correctly and arguments between the community and Roda as to who fixes it and who pays are still ongoing as seems to be common at Roda
Not a very satisfying response for owners in block 37 who pay their fees.

Just read your email, you offered to help and give independent advice regarding the lift situation in block 37.
You say that in your experience potentially solvable solutions can be more readily available than first expected.
We have a penthouse in block 37 and completed in 2007, the lift did not work the day we signed and since then we have reported the lift problem many many times to the Housing.
Last summer 2009 we was stuck in the lift after ring the alarm bell and shouting for help nobody came to our assistance and in desperation we had to force the lift doors open and jump down to the next floor which was very dangerous a disaster waiting to happen.
We complained to Housing and they said they knew of the ongoing problem since it was installed.
The next time we contacted Housing was to inform them that we needed the lift working to access our penthouse for a disabled relative who was in a wheelchair and was about to visit us, then two days before they were due to fly over the lift was broken again and they had to cancel the visit.
We visited the housing office to complain once again and although they were apologetic only temporary repairs have been done,
we have emailed Housing Monday 9th August to complain and report lift once again broken but have not had any response todate.
All our community fees have been paid in full.

It is my understanding that the problem within 3 blocks in Phase 2 is water leakage into the lift shaft making operation of the lifts both difficult and dangerous especially in block 37 which is the worst affected. I think what happened to tops ensured the lift would be switched off thereafter.
I have only recently been made fully aware of the problem, so much for being a Vice President, and I am apalled it has taken so long to sort things out but it appears everytime the developer, Roda tries to correct the fault they have failed to make a permanent repair and a recent survey has advised what needs to be done.
Apparently Housing, on behalf of Phase 2 P12 community have asked Roda to make the correct repair on numerous ocassions but this has still not been done.
It has now been agreed that if the work is not completed by Roda within the next week then the community will hire a contractor and seek compensation through the lengthy legal process, not sure why this could not be done sooner.

I cannot advise on Spanish Law but common sense says owners should be entitled to claim compensation against their fees if facilities do not work but you would need to take professional advice on that matter.

Thank you to Chris (hugh_man) for keeping us updated as it seems no-one else from the committee care less about the situation. I do fear about the ability of our committee if something as dangerous and urgent has just been made aware fully to one of our vice-presidents.
I would like to confirm as an owner of a penthouse apartment in block 37 and having completed in 2007 this lift has been faulty and dangerous to the public since the very day of installation. EVERY time we visit our apartment there are either engineers working on the lift or it is out of order. We have on a numerous occasions been inside the lift to be standing trembling and fearing for our lives with the shuddering, grinding, jerking, rattling vibration coming from this life threatening device.
On hearing TOP's story about her and her family being stuck in the lift TWICE horrifies me but more importantly angers me to think that she has complained repeatedly to housing and received little or no support from them.
I strongly feel that our committee and Roda Golf should have taken serious action long before now (not 3 years) to control this Major Accident Hazard and act in the public interest at reducing the risk of death or serious injury to anyone. From a Health & Safety point of view surely it is their legal duty to ultimately inspect, investigate and enforce immediate action to avoid prosecution on any serious injury or death which may have been a result of their negligence.
I do hope this situation is given number one priority on any agenda and resolved immediately.

I went to your apartment block yesterday, but as I said, without the proper access, there wasn't much I could do.
I did however see a couple of points of concern that would allow water ingression.
I would recommend acting as Chris has said and contact housing and your president, once again.
