Hope someone can advise please.......

I have just received a letter from Advisors Bureau Consulting SL, (the Insolvency company which has taken over from Aldea Advisors). They have contacted me requesting that I pay 50 euros (& VAT) to cover the costs for the following:

- As a Spanish property owner I am expected to pay TAXES - Council TAX & Income TAX. Even if I do not rent the property out I am expected to pay TAX.

Question: The property at Almanzora CC has not been built. Where do I stand legally paying TAXES when I do not have a property to pay TAXES on? This seems very harsh.

- As a non-resident I must appoint a fiscal representative in Spain to ensure that these TAXES are paid, hence the 50 euro fee. I had already paid this amount to Aldea to act as the fiscal representative.

Question: Should I have to pay this agian?

Should I have to pay this fee anyway given that the property has not been built?

- They are asking me to sign a contract with my personal bank details, and to enclose a copy of a IBI/SMUA (Council Tax) so that they can calculate the Income Tax due 31st Dec 2010.

Question : I have never received an IBI/SMUA (Council Tax) document...should I now have to start paying this now given that it has never been paid before, and, also it seems harsh that I should have to pay tax on something that has not been built yet?

 anyone else received similar correspondence? Can anyone advise what I should I do, as I feel extremely uncomfortable paying out further monies on aproperty that has not been built!

Also, given the insolvency of Aldea, is anyone using Advisers Bureau Consulting, or have you opted to use an independent Solicitor for future services?

Hope someone can help and provide some clear advise with this. Thanks in advance.

You don't own a property, therefore, you don't owe any taxes.

 

I suspect that you have received a generic email - one which has been sent out to everyone on their data base.  My advice would be to ignore it.

I would ignore it as it's probably a hoax or another Spanish scam !

I am an ex ACC nearly purchaser (property started by never finished so VOID contract Mr Huma) and If by any slim chance this email is genuine then it is a major insult to everyone who in good faith was purchasing on ACC.

Would any of them get another penny out of me ..............don't think so.

Pass the email to Mr Huma who can pay all / any taxes etc for the property he never provided.Presumably he owns the land so they can sell that, pay all taxes AND refund the 100's of people he owes money to.

tell them to get the 35k deposit that Huma stole from you and take the 55euros out of it, i will give them the same if the get the Huma conmen to pay up.

Julie, if your property has not been built, then you do not need to pay any taxes. You received a generic letter addressed to all clients on their records. Best thing is to contact them and tell them of your situation, and they will just update their records.

By the way, when you own a property in Spain you need to pay two taxes: SUMA Tax (like the Council Tax in the UK) and non resident Income Tax. This tax has got nothing to do with income obtained from renting the property. Advisors Bureau Consulting can explain it to you.

It definitely is not a hoax or a scam. Do contact them. You´ll be pleasantly surprised (I was).
