Hi All

Our solicitor had promised that by today hopefully the land registry should have been rubber stamped, however still no news & have not been able to get hold of her today.

It is getting extremly frustrating & we know it is out of Taray's control, but we were originally given a completion date in December(& bearing in mind letters went out from Taray in December saying the properties were ready to complete!!!) & it has kept going back since then always with promises that everything will be signed off in the next fortnight. We went over on 27th January as we should have completed by then. We now have another week booked starting on 24 Feb to go out & furnish the property, but this is looking more unlikely by the day.

Any news anyone has got on the land registry would be gratefully appreciated.

Hi All

We have just had an email from our solicitor saying that the land registry has still not be signed off & even though Taray have put pressure on them to speed it up they will not be pressurised & that it will come through as & when.

We are really disappointed as it is now putting our trip next week in jeopardy when we were going out to have all our lights fitted, furniture delivered etc. (& it's raining here!!!!!)

We would still be interested to hear if anyone else has had any info this week re the land registry

Hi Sue & David,

Same as you I'm afraid, our solicitor confirmed today that nothing is through yet and so our mortgage cant be agreed. We have been given details of another bank that might be prepared to give us a mortgage on the property without it being registered, and possibly by next week (!) but we dont know what interest rates or charges etc.

As soon as we find out we'll post again in case anyone might be interested, but at the moment having paid all the fees etc we are inclined to stay with our current (potential) lender (Halifax Spain).

By the way, its been raining here as well!

Hi Ken

The land registry rubber stamp the paperwork in order to produce the new building declaration deed which is necessary in order to sign your title deed for the property. This is then followed by the end of works deed (Fin del Obra) approximately 15 days after the new building declaration. The LFO is the certificate of habitability which can be applied for by Taray once they feel that the site is up to a standard that will be passed. The LFO is the final part & this is why you are on builders elctric until this is signed off.

This is our understanding as advised by our solicitor.

According to our solicitor back in January the land registry was applied for on the 27/11/06 & generally takes 4 weeks to be granted. For some reason this is taking months. We keep getting told it is going to happen in a fortnight, but that has been for the last 8 weeks. Our solicitor has reassured us that this is not Tarays fault, it is just the land registry office not having enough officials for all the building work that is going on in the area. It is extremly frustrating not only for us, but for many other people on the site.

Hi Sue & David,

It's a mine field of  bureaucracy and difficult to get your head around ! We were told by our solicitor in December that Taray had the fine de obra but not the LFO yet ? From what you say here they cannot have this 'fin de obra' yet !  I emailed our solicitor again last night to asked if he had any reply from taray about the LFO. Specifically had they applied and could they show a copy of this application in any way ?  He replied this morning saying he requested an update on this from Taray on Monday after we visited him at his office but to date he has had no reply from them. During our meeting with him on Monday he knew that at 31st December 06 Taray had not applied for the LFO, so if they have done it by now, it would be within the last 6 weeks.

We'll get there. Eventually..

Hi Ken

Our solicitor spoke to Taray yesterday & to quote she said

Taray is calling every day to the reigstry, but it's no use at all as the Land Registry Office have said to them that they will take the necessary time to have evrything duly registered and that pressure put on them will not speed up he process.

As from our experience with Taray, they have not had any problems when getting the necessary documentation in order to sign the title deeds of their promotions, so I don't think there is any problem at all. Sometimes land registries have a lot of woek and they are not able to deal with all the applications at the same time. However and once again we cannot assure you of an exact date.

The LFO has not even been applied for and is unlikely to be applied for until one month and a half after completion

Hi David & Sue & Ken,

Thanks for such an excellent explanation of the 'minefield' legal process we are all stuck in, and thanks Ken for all the superb photos youhave posted - puts our efforts to shame!

We also looked at the Balsicas development a year ago, and were initially quite taken with it due to the fact it had a station. However, as this also meant that it was so close to the railway we thought that this could turn out to be as much of a nuisance as as a potential benefit, and plumped for the (hopefully) peacefull delights of San Cayetano instead. Looking at Ken's photos of the new up and over road (which we were also told nothing about) now being built at Balsicas we are so glad we did!

We will be coming out again from 25 Feb to 1 March, as this was going to be our completion date, and the date when all our furniture was going to be delivered. Thanks to the guys in Madrid this now looks increasingly unlikely, but you never know!

We will be staying at Villa Martin, but popping in to San Cayetano from time to time, and it would be nice to bump into any of our potential new neighbours whilst we are there. It was very quiet last time we were over at the end of January, but we did meet Mr & Mrs Volfen, and they kindly pointed us towards this excellent forum!

Hi All

Has anyone had any updates on the land registry today??? Any news would be greatly appreciated.

Our solicitor was supposed to be coming back to us today with an update so we guess as she hasn't there is no news. We are supposed to be going out on Saturday & having all our furniture delivered on Monday, but this is now looking unlikely once again.

Did anyone else have letters from Taray dated 14th December telling you to get in touch with your solicitor to arrange signing of the title deeds?? Our solicitor now agrees that Taray should not have sent this letter out until all the appropriate paperwork was in place. She also tells us it is very unusual for Taray to be waiting this long for the paperwork- we don't know if that's reassuring or not!

We are feeling very disillusioned at present as if we change our flights we have no idea when to change them to as we have gone past 2 completion dates & keep being promised that everything will be in order in 2 weeks, but it is now 10 weeks since we had the letter telling us we could complete.

We know once we do complete it will all be worthwhile!!!!!

Hello Sue & David,

Checked with our solicitors today and I'm afraid nothing is through from the Land Registry yet.

We got the letter from Taray in December. I guess it's not their fault if the Land Registry let them down. Whatever, we're going out on Sunday as we could do with a bit of sun (hopefully!) so you wont be on your own!

You could always give your solicitor power of attourney to sign in your absence so you could complete quickly when it does come through - just a thought?

Thanks for the info

Our solicitor does have power of attorney & keeps giving us dates & promising that it is going to happen, we book flights for 2-3 weeks after the date just in case it delays, but this doesn't seem to help. We know it's not her fault & deep down we're still really excited.

When we went to the Taray offices on the 28th January they said they had definetly been told by the land registry that it would all be sorted in 2 weeks.

The main problem is taking holidays from work, perhaps we'll just have to wait now until we're over at Easter - surely it will all be sorted by then

We are making a decision on whether we delay coming out tomorrow after Sue has spoken very nicely to her boss to change her hols

Hi All

Our solicitor has spoken to the land registry office &  today informed us that they have a serious backlog at the land registry & can now give us no idea of when our property will be registered.

She has offered us the alternative of completing without the land registry, but this means that in legal terms our property does not exist (only the land which it is built on is registered) This is not a route we want to take & will sit it out & wait for the legalities to take place.

Once the land registry has been sanctioned, we've still got the Fin Del Obra & the LFO to go - could be a long process & reading the comments about June for the LFO on the block 2 thread think this is being optimistic if they have to go through the same channels to get the LFO which has not even been applied for yet. It is now 12 weeks since Taray applied for the land registry!!!

Hi All

In the end our solicitor has advised us not to complete without the land registry as the houses do not exist in law without this document. I know some people have already completed, have you managed to get some written agreement from Taray ??? We have emailed Taray 3 times last week & not had a reply so we will try to phone them tomorrow.

We were under the impression it was all of the first phase which has not been registered, but is it just the quads???

We appreciate the LFO may be some time off as that has not been applied for yet & as Ken's pictures show half of the road on Calle Mandarino is fenced off still as they are building the other side of the road so I suppose it is unlikely Taray will apply for the LFO until the road is completly clear.

We are really confused with  it all

HELP - If anyone out there has completed can they let us know how they've managed it without risking all

Hi Sue and David,     the land registry hasnt been granted on any properties as yet  ....We met up with Debbie and Steve on Thursday  ...they are waiting   to sign up on their penthouse   and do not want to do it without this document  there are some that have obviously signed beecause they have moved in    Personally i agree it is not advisable  as the properties do Not exsist legally

Thanks for the reply. We thought that was the case, but were slightly confused as we had a private email from someone who has completed on an apartment. We persume that they must have something from Taray protecting their investment, because our solicitor has said that the bank guarantee only stands until we have signed for the title deeds so any signing prior to the land registry being granted would be at our risk.

Hi All

We have just returned from Spain today and were told about this site whilst we were out there by a future neighbour. Our visit was supposed to be to sign the title deed but just like everyone else were waiting for the nessassry documents to complete. We will be back out in Spain on the 10th March with a view to complete on the 14th but not holding our breaths. Will anyone else be out there at that time as we would love to meet up. We are buying plot 30 manzana 3 quarter villa. Paul and Christine

What did you think of the Taray site so far? Ive heard many people have moved in already, did it look as if a small community was developing already or is that a long way off yet?

Wouldn't it be great if someone who had already moved into their property got on this site and let us know how they were getting on!!!!!...... hint hint

The site looks fabulous and the weather was great, which gave you a good feeling about the place. We are supposed to complete on the 14th March, if it happens we will be out there for 12 days, taking delivery of our furniture etc. One slight problem we found if you guys have a quarter villa like ours is if your having air con installed the villa behind ours has put there 4 units in the designated area above the utility area (2 side by side, then 2 above) which come over onto our part of the house and now there is'nt enough room for ours to go along side them. Taray should have made the gap wider to fit in 4 units required. So we will have to install 2 of our units on the side wall of the cut out area above the utility room. So if your having air con have it installed before your neighbours.

Cant understand why one quad needs 4 air con units ?    We are having 2 fitted, one for downstairs ( 2 rooms ) and one for upstairs ( 2 rooms )...if someone gets aircon units fitted that encroach onto your property, then you can make them have them moved !  ...it is after all, your property !
